Do I have to pay for return of item?

Hi

I ordered a tennis racket from a web site. The racket I ordered was a babolat aeropro drive junior GT. They sent me a Babolat Aeropro drive junior.

The GT is the newer model and is about £15 more expensive than the older one. I emailed them to ask them to rectify the situation and they responded by apologising and asking me to send it back and they will send the correct one out.

My first question is do they rather than me have to pay for the return shipping? According to them the item also needs to be insured ,do I have to pay for this? The item cost £75.

Also I would rather have my money back and order from somewhere else as:

After checking their website the racket I order is down as being a discontinued product when in fact is a newer model than the other one which they are still selling - and if this was correct anyway how could they send me the correct racket when it has been discontinued.

Hope someone can help as this was a birthday present for my 9 year son and he's going to be disappointed.

    As you recieved the item and it is not "as described", the retailer is legally obliged to pay all costs in returning the item. Which site was it?

    Which site did you order from? It wasn't tennisnuts, was it? If so, we had a similar issue some time ago, and I'd recommend that you are very careful when returning items, and make sure that you send them tracked.

    The site was total-hockey.com but they asked me to send it back to:

    No although I was going to order from tennisnuts first but their online ordering woud let me pay with my cards/computer ,don't know why. I should always check for phone numbers as well because on lookign total-hockey.com have no phone number on their site whereas at least tennisnuts do.

    Have emailed them back again stating I would like a full refund and either freepost or refund of my p&p cost as per "Sale of Goods Act" for goods being "not as described". Hope they go for it

    There is a phone number on their contact us page.

    No, if you look carefully there is place for a phone number wher a place holder says.....Tel: .....as per your clip but there is no phone number

    Tabath, I'm not trying to be clever, but I honestly cannot understand why you cannot see the telephone number.

    Their phone number is shown there and is 028 4066 2684, which I listed in my previous post anyway. Was that no help? ;)

    Can anyone else see the phone number, or am I imagining it?
