It sounds like a dumb question but do you have to go down the hardship route or can anyone hit with several years of overdraft charges etc claim? I've never been unemployed but there's not been a lot of money around for the last couple of years or so (like so many people) but I doubt if I could count that as real hardship.
I found this site literally 1 day after shredding the last of our old bank statements and came to moneyexpert to look into starting up a new account now I'm getting divorced - imagine my annoyance at my haste! I do have the last statement though and I see Santander have just hit us with a couple of 'Instant Overdraft' type fees so I reckon there'll be more.

Have a read of the excellent MSE article on reclaiming bank charges. I think it'll answer all your current questions; who can, on what grounds, the risks involved, the likelihood or otherwise of success, etc. If it doesn't answer all your questions, please post again
