I am a member of a local gym and I never go I want to cancel the membership. :T
But... cant find the contract. I ve spoken to reception and they said I cant cancel until ive had the contact for a year - first payment was in August 09.
ive written to them, via email and notified them that I want to cancel and gave them 30days notice of this. is that adequate?
My most recent dd came out of the bank on 1/4/10.
Can anyone advise please?

You have signed a contract for 12 months. It doesn't matter that you can't find it. You can give them one months notice at the 11th month. You do have rights......but you still need common sense.0

Oh my god not this again!!!!
you signed a contract for a years membership so therefore you can't cancel until that year is up, even then you have to give 30 days written notice so it usually ends up being a minimum of 13 months contract...
you are usually best to write and sent it recorded delivery as most gyms "lose" cancelation requests!!!0 -
It depends what you agreed with the gym (i.e. what your contract says). If you agreed to pay membership fees for at least a year then you can be taken to court and sued if you fail to pay. That's the whole point of a contract.
Hope this helps.... :-)0 -
If ive just been made redundant would they still pursue me through the courts? Surely its not seen as a priority to pay in these circs?0

How can anyone advise when they can't see your contract?
If this is genuine (I notice the name of the Gym isn't mentioned- why?) then ask the Gym for a copy of the contract, however most gym memberships run for a year and if you choose not to use it then that's your problem.
Whats your redundancy got to do with it? Just as having 16 kids to support or a sick relative, it's not relevant and if you stop payments, then yes they can persue you through the courts....probably!0 -

If the contract is 12 months, then legally you have to be able to cancel at 12 months. Whether this is by 3 months notice at 9 months, or 1 months notice at 11 months. They cannot make you stay for 13 months if the contract states 12.You do have rights......but you still need common sense.0 -

Depends on the gym. If this is a genuine reason, try speaking to the manager directly (only if an independant gym, a chain would not give a to55)You do have rights......but you still need common sense.0 -

When I cancelled my living well membership (was a couple of years ago) I was required to give 1 months notice and could only do this after the 12 month, making the total membership term 13 months... Fact!! don't pick holes in my post :mad:0 -

Well you either agreed to an illegal contract, or the contract was 13 months and not 12!You do have rights......but you still need common sense.0
