Just an update, our LL has said he's happy for us to exchange it for a bigger model and take the extra amount off the rent. What a nice chap

If I'd have known the exact situation I would have done, but wanted to be sure of my rights first before approaching him.

With regards to the deposit, I am happy to let this lie if it means we have more power at the end of the tenancy
Then tenancy deposit scheme was put in place to protect YOU the tenanct. Not holding him to it is hardly giving you the power. I hope for both your sakes that you have an amicable end to the tenancy because I foresee a mess ahead

If the freezer is on the inventory then he should replace or repair it, however it's not an insurance policy, he is not obliged to provide like for like. If he turned up with a freezer suitable for a small dwarf with an eating disorder this would comply with the terms of the contract0
