charges on property

can anyone help, i owe money to somebody whom is now going to put a charge on my property, can this be done with my consent, even though my property is in the market and i havent paid this months mortgage payment?

  • To get a change on your property, you would have first needed to be taken to court, found liable for the sum owed, not paid after 21 days so a CCJ would be registered against your name. At that point, the creditor could potentially apply for a charge on your property (depends on how much you owe!)

    So to give an accurate answer to your question, how much to do you owe, to whom and what for. In addition, have you been served with court papers re the debt (normally on an N1 form)??

    Can if be done with consent? No. You would need a court to authorise it. Your mortgage company would not be happy to let you give away some of their asset! Further, if you don't pay your mortgage, then your lender will shortly begin proceedings against you to recover the house. Note that any shortfall in balance (i.e. You owe £100,000 and the house sells for £90,000) then the lender has 12 years to chase you for the debt. It might be wise to talk to them with the help of a debt adviser.
