cat c write off - twice!! insurance knowledge needed

I thought the VIC check was easy car CAT C need a VIC to get it back on the road but no they have to complicate the matter by not making it necessary until the tax runs out or the vehicle is transferred.0

Hi all,
Following on from the discussion above I was just wondering if anyone knew if the following statement is true:
"By law nowadays if a car has already been written off once it automatically becomes a cat B write off should it need to be written off again".
The reason I ask this is because over 11 weeks ago my car was stolen. A week previous to that it had received a 12 month MOT (thus it was in a road worthy condition when I parked it up for the night). During the event the thieves smashed the rear quarter light and hot wired it. It had very little petrol in it (as I was goign to fill it up the next day) so they literally drove it 250 yards and parked it up. As far as I'm aware there was no further damage and the original garage to which it was recovered by the police said it would need approx £150 worth of repairs.
After much chasing of the insurers and numerous obstacles they have finally given me an offer of £275 (with my £100 excess to come off that) and have told me that I can't have it back as it is a category B write off. When I questioned this decision due to the facts above I was told that given it had had a category c write off previously (when it was owned by my sister in law) it automatically becomes a cat B and we'll never see it again.
Given that I have been told that this is legislation I have tried numerous online searches but have found nothing so I'm praying that one of you might know if this is true or if I'm getting screwed over by what can only be described as a farce of an insurance company! Unfortunately despite them being so appaling they employ some really nice women who have been lovely and so I can't seem to vent my spleen at them...
I would be most appreciative of any advice that anyone can give as I'm starting to tear my hair out!
