Question regarding bank time limits

Hi, I apologise if this is answered somewhere else but have trawled through the 'unfair bank charges' thread and asked but noone seemed to know!
I am currently claiming my charges back and personally delivered the request for statements letter last Fri (4th August). Do I have to wait 40 days from then until I inform the commisioner or 40 working days?
Does anyone know who the Retail Regulatory Risk Team is with Nat West...apparently. in a letter from Nat West received yesterday (already), the case has been passed to them. Who are they and what powers if any have they got?

I don't think there is a timescale as such for claiming back charges. There is a 40 day limit if you are requesting data under "subject access" however.:A0

Thanks david, it was the letter you were talking about, to request my statements (DSA) but is it 40 days inc weekends or a straight 40 days from friday, also, any answers regarding the 'Retail Recovery Risk Team??

16. Both the Convention and the Directive require access to be provided "without excessive delay".
17. The 1998 Act requires requests to be dealt with "promptly" and in any event within 40 days. The 40 day period begins on the day on which the data controller has all the information he needs to identify the applicant and to locate the data requested, along with the fee, if any. The 40 day limit has been unchanged since the implementation of the 1984 Act. However, the requirement for promptness was newly introduced by the 1998 Act.
The "Retail Regulatory Risk Team" is the name that NatWest have dreamed up for their department who deal with these requests.
I'd get in touch with them and say they're outside the 40 day limit and therefore in breach of the DPA, that should scare them! Of course they might have posted the stuff out and it's got lost somewhere, the report could well be very big.
Or there could be some other loophole, like they've not received your payment for the report etc.
