RBS - Bank Charges

I asked today in my local branch if i could reclaim charges £35 they had took off me, i haven't claimed anything back from then since i opened the account.
The teller said if it was a bank error then yes they could refund, if not then no way have i got a chance.
It was a DD that had came out, which i had forgot all about. I am on JSA at the moment, i explained that to the teller, but they said since the law was passed a couple of months ago they couldn't refund unless bank error is this correct?

What law and no she was referring to the bank charges case. Perhaps you could have argued that your good record with the bank might have been reason to refund the charge.0
