I have just took ny diabled dad for a meal at the packet steamer which is also a travel lodge. He has not yet got a disabled ticket so I asked the manager if I could park in the disabled bay. They stated it was fine and that the land was theirs. To my discust, I had a parking ticket for £80 on my windscreen when I returned. The manager explained that they do not issue tickets and had never seen this before.
Is it illigal to give me a ticket if the land is owned by the restaraunt ?

not sure about illegal but certainly cannot be enforceable. I would just write stating the managers approval and that you will not be paying (sent recorded mail).Back by no demand whatsoever.0 -
Was it from a private contractor or does the land belong to the council
If private, dont write to them, dont pay them, ignore them completely.
You will get threatening letters saying they May this and they May do that.
These tickets are unenforceable. Only councils and police can issue ;fines'
They are unenforceable invoices so ignore, ignore, ignore.
Have a look on the Pepipoo site for reassurance but Im sure more people will be along here soon.
They are scammers so just file the letters behind the clock. lolmake the most of it, we are only here for the weekend.
and we will never, ever return.0 -
McKneff is correct.
Do NOT contact them. If they want to take action, they will have to enforce the action against the driver of the vehicle. Unless you tell them, or they were using CCTV in the car park, they cannot prove who the driver actually was and so cannot bring a case against anyone.
This is not the same issue as a proper parking fine from the police or a local council, it is a civil matter. They are powerless to force the registered keeper of the vehicle to divulge the information that they would need.
Besides all the above, the ticket, which is an invoice inviting you to pay, is unenforcable anyway.0 -

I've got a "parking enforcement notice, railway byelaw 14" from APCOA. I parked at a station car park, couldn't get through 1st time to the telephone payment, and forgot. I did remember later, and phoned the automated system, got a ticket. However, by that time, I had the notice. I've looked at the main sign in the car park, which says they will regard me as in breach of contract and apply a charge of £80, reduced to £50.
I've complained that this is disproportionate, and that I did get a ticket later on, but they've replied saying I should have done it within 30 mins.
Their ticket threatens to get a summons issued at a county ocurt to include any and all costs included in recovery.
They do not give any way in which I can challenge their ruling.
Advice?0 -
If yhey mention Railway Byelaws and then go on to say you will be pursued through the county court, they are scamming you. Railway Byelaws are dealt with in the Magistrates' Court.
Quite simply, they have no losses, because you have paid to park.
As Trisontana advised in the post before yours, why not try the Parking Fines, Tickets & Parking board, for further information?0 -
Hi - I received a parking ticket at a retail outlet shopping car park. As advised I have ignored all previous letters from (A.A. Hutton LLP, Perth, Scotland) but today I received another one from them stating that unless I pay within 7 days they will consider instructing legal proceedings against me. They also state that if a Court Order (Decree) is granted against me I may incur additional legal costs (ticket is £70.00 presently) and the recording of a Decree against me is a matter of public record and my credit status could be affected. I note that sometimes there is conflicting advice in the Forum regarding payment, anyone have difinitve advice?0

Usual rubbish. Note the words "will consider". This is what all these companies do. They try and bully people into paying by employing these meaningless threats. Just ignore and don't pay. ...I received another one from them stating that unless I pay within 7 days they will consider instructing legal proceedings against me. ...
I've had letters like this from one place, mentioning 14 days for around 3 years... (it doesn't even say will consider, it says WILL.
Anyway, as everyone else says, this is most likely a scam and not enforceable.
What you SHOULD do though, is keep all the letters AND envelopes from these places, just keep them stored away. And always refuse to talk on the phone (either say nothing, or say writing only and never give any extra details or confirm any details even if you think they may already have them).
Multiple letters without any actual action can be considered harassment, and you could start to build your own case against them... I've kept all mine but they seem to have stopped in the last 6 months so I cannot be bothered although I will still keep the letters for a number of years (up to 6-7).
To show you how much of scare mongerers they are - I even got a (postman posted) cardr saying a Mr Brown (forgot the name) will be visiting on Thursday to try and recover the money, no date, just "Thursday", from looking online this company always sends out "Mr Brown will visit on Thursday", and no one ever, ever ever ever ever ever turns up.0 -
A maintenace man was called to fix broken Freezer he used entre code to enter security gates to parking area & parked his vehilce in bay for the property. He returned to his vehilce and found Ticket from Shoal Enforcement on his screen. The ticket is for £120.
They are saying pay first and appeal afterwards. He wrote a letter saying "As instructed by agency to attend an emergency Freezer repair I parked in bay 13 for 13
Appartment" and sent no payment, Shoal replied by sending a printed paper with a list of bullet points under the heading of Appeals and said pay before we look at appeals. Does any one know if this is enforceable.0
