Urgent help with bank and link financial

Help please anyone,

We had a letter from Abbey back at the beginning of March telling us that through the ruling they are now closing our case. We did not reply (our fault) but now they have sold the debt to link financial. They sent us a threatening letter to which we responded by telephone telling them that we are investigating our complaint further through the hardship ruling. I sent a letter to Abbey on the 1st April by recorded delivery although not had a response yet. Now link have started county court proceedings against us. Can anyone help out as not sure what to do now and still believe that the orginal overdraft with abbey was due to the amount of charges levied against us as they would make take us overdrawn, offer us an extension to our overdraft with an unreasonable deadline then cancel the agreement and charge us again. We are thousands in debt and just managing to save our house by the skin of our teeth. The next stage would be to take an IVA or declare bankruptcy which we don't want to do as feel we are fighting our way out of it. Please can anyone help?

    Don't worry.

    Even if they take you to court and even if they win, just explain to the court the financial hardship you claim to be in and if the court agrees, then repayment of any amount owed will only be set at a rate you can afford ... which might be very low indeed if you can convince the court accordingly :)


    The only danger you have is that you say you owe thousands. If you owe £750 or more to a single creditor (or creditors combine together to get to that figure) they may petition for your bankruptcy ... but don't worry about that until, or rather if, it ever happens.
