mbna taking an unauthrosed DD

Hi all,

My problem...:mad:
I have gone through my in goings and out goings with mbna and have agreed a sum to pay them towards each card (2) every month. This was set up at the beginning of march.
Or so i thought,
I then find they have taken all together around £165 from me, which meant i was charged £5 per day (£20 all together) and £25 for a failed DD.
My account manager, i feel was rather rude to me and didnt car that they had actually taken ALL the money i had in the bank.
I have asked for my money back and I have asked for a refund of the charges that were made as they were caused by them not setting up my DD corectly.
I now have to make my payments manually this month and hope they have got it right next month or i will be penniless again!
Am I right that they have to pay these charges? And was it wrong my account manager saying that thay did it out of courtesy?!?
I am very angry at his attitude and he was almost spoiling for a fight. Also very unimpressed he seemed to think it was ok to call me by my christian name all the time.

Any advice would be greatly received!:)

    Did you agree to the repayment plan with MBNA by phone or in writing? if on the phone it will be hard to prove what you agreed.
    I'd recommend in future you only negotiate by letter, also it might be better to set up a standing order rather than a DD, as then only you can change the amount to be paid.

  • you can cancel a DD at any time you wish.
    The money that has been taken can be claimed back simply tell them you wish to claim indemnity. under the DD 'laws' they MUST tell you the amount they will claim and a date on which they will claim the maoney. failure to do so break the DD code of conduct. I would suggets that that you speak to the account managers immediate line manager and make a formal complaint.
    Cancel the DD leave it for a month or so and then set up the DD again (if you wish).
    Also they have NO right to address you by your christian name - i would also make a formal complaint - if the bank is the HSBC drop me a PM as i have the direct email address for their head man and i have had my issues sorted out within 90 mins. xx

    They have a right, all you would have to do to stop them having this "right" is to say.. "I'd prefer it if you called me by my surname" and bobs your uncle that's what they'll do.

    They fully accept what we agreed but have failed to honor it and have taken two amounts which would have been a minimum payment.....grr
    I am extremely angry at my account managers attitude though. I think it was actually his fault it didnt happen, as i has spoken to others previously and he had to actually 'action' it himself.
    Me thinks he was covering his tracks.
