dla/miss diognosed

i was miss diognosed last year and turned down for mobility dla,when i was diognosed correctly i have asked them to look at it again,they rang me tuesday and i explained all that went on,and the lady said they would let the decionson maker lokk at it again,i have today recieved a letter saying no,and dated the same day as i spoke to them,i cant see how they have looked again,they can only have looked at what my doctor sent origonally?

    Diagnosis doesn't matter when it comes to DLA it depends on your care/mobility needs. Your knock back letter would outline why you're not entitled, if you disagree with what they said you can appeal.

    yes i understand that,but the doctor was not aware how bad i was,so the report they sent to dla was incorrect

    when i spoke to them on tuesday i asked them if they needed a report from consultant and doctor and they said no,so i think they decided no already.
  • The decision would have been based on all the information provided.

    When claiming DLA, you have a responsibility to yourself, to advise your GP on how your condition is affecting you.
    When the DWP write to your doctor, they are asking for a factual report. These reports, so should contain all your medications, treatments and symptoms. Even with an incorrect diagnosis, the doctor will still have a record of the problems you are suffering from. It's no different for a person that is still going through the process of being diagnosed.

    I am wondering about the timescale here.
    If you were misdiagnosed last year and turned down for DLA, you would have 28 days to appeal that decision.
    Did you leave it over the 28 days before asking them to look at your claim again??

    yes it was over,but i was in hospital and wernt well enough,they accepted that it was late.i understand what u are saying but what i was trying to say was,no matter how much i told the doc and hospital how bad i was they were treating me differant than they would have done had i known what was wrong with me

    Your treatment is not part of the DLA criteria. DLA is not concerned with diagnosis, it looks at your care and mobility needs.

    I think you could do with some assistance. If you contact CAB or Welfare Rights there should be someone that can help.
