    but the right of a tenant to refuse access when it is not an emergency trumps this

    Actually I am a landlord.
    And I am well aware of the laws regarding 'quiet enjoyment'.
    The standard ARLA AST that I use has a section on Access & Inspection which is subtitled 'co-operating with the landlord & his agent'. The clue being in the title - it's about co-operation, & the tenant does not have to agree. Check with your Landlords' Association for further clarification.

    I would move out and tell the !!!!!! to stick it up his backside. You have a business arrangement, your landlord isn't your dad no matter what he might think.

    I am quite glad we've only been inspected once in 18 months. Every three months sounds like a ball ache (I too have a black cat and carpets in the "rental house beige" shade so favoured by LLs and hated by tenants. We don't have rugs cos the cat folds them over to try and trip us up).

    You can add as many unfair or unenforceable clauses to your AST as you like, the only real right the landlord has in this area is to serve the tenant with an S21 notice to quit if they are unhappy they are not allowing you access to their home.

    "The tenant has the right to quiet enjoyment of the property for the duration of the tenancy along with the legal right to live in property as if it was their own home. This means that they have the right to a peaceful existence without undue disturbance. Harassment is a criminal offence under the Protection from Eviction Act 1977 and may result in the landlord being fined, or even imprisoned in extreme cases. Harassment can take the form of:

    Entering the property without permission.
    Changing the locks without giving the tenant warning or new keys.
    Cutting off utilities such as gas water and electricity.
    Tampering with mail or possessions.
    Verbal or physical abuse or threats.
    Enter the tenant's home whilst the they are out."

    You absolutely can insist on being present, the appointments DO NOT have to be at their convenience. :mad: The landlord or his agent is not allowed to enter your home without your express permission, and you can withdraw that permission at any time.

    The only thing on that list that might damage the landlord's property is the powder in the drawer, IF it were allowed to build up to the point that it cause a blockage in the washing machine. I assume you run a service wash occasionally (hot wash, empty machine, no powder) and empty any filters?

    Last three month inspection we had (they tend to let ours lapse into longer gaps now they know we're not wrecking the place) they were really grotty about letting us rearrange it to a time when we could be in - lots of heavy arm-twisting and trying to imply they had the right to come in when I wasn't at home and I was being unreasonable questionning it.

    I had to stand my ground and say, "Look, I have no objection to you coming to check on the place, I'm not the sort to refuse access, I just would like to be here when people are coming around my home and I'm unable to make the appointment you sent out." Think I did push and say that I was conceeding a lot more than I had to do legally to get through to this girl in the office that I wanted to be there... I know it's a bit daft but I don't want people in there when I'm not there and this lass was obviously new and pushing things a bit too heavily really.

    More than anything else - people underestimate just how fast a three legged cat can be as an escape artist - I don't trust them not to accidentally let her out!
