consumer rights internet order. please help

Hi, I am wondering if anyone can help?
This might be a little complicated due to the circumstances however I have never been so angry!:mad:

My parents, younger brother and teenage sisters all emigrated to australia 2years ago. When it comes to birthday/christmas/easter etc It is far easier to order items from an australian company and have it delivered right to their door, than buy something over here and send it in the post, pay a fortune for postage and risk any dammage. I have done this for two years, without any sort of problems. Until Easter that is.

I ordered a hamper of chocolates (please tell me if i'm alowed to post the link to the company) for the three teenage siblins, knowing there was plenty of chocolate in there for them to share happily.

I ordered the hamper on 30th March, and paid $20(about £10) for delivery, which i thought was expensive, but it was gaurenteed to arrive on the 3rd may, the day before easter.

I spoke with my parents on friday 9th, and the hamper still hadn't been recieved. When I jumped on their website I could find no specific email address to contact them on, only an australian phone number. Luckily however, I did have a confirmation email from them, which was addressed customer services. I emailed them at this address, explaining how upset I was that the hamper hadnt arrived for easter, and could they please advise me as to what had happened. I also mentioned canceling the order, due to the high postage charges when they couldnt even get the item delivered on time. I asked them to contact me.

We are now 6 days on, and i've just spoke to my mum again. She said they recieved the present yesterday. However she was baffled as to what i had ordered. It was a stuffed rabbit and a small chocolate egg. NOT the basket of 20 chocolate bunnie lollipops, several small eggs and a large egg.
My brother and sisters are stroppy teenagers. They have no interested what so ever in teddy bears, nor can they share it! Let alone the tiny egg! If i wanted to send a teddy, i would have gone to asda, paid £10 for a huge one, probably paid another £15 to be sent and total would have cost £25/$50....drastically less than the $79 I forked out!

I am so upset, and disapointed as its ruined what i thought would be a lovely, thoughtful gift.
I have emailed the company, but hold no hope of them contacting me. My mum has said she will try and call them. I've asked in my email for a refund.

Sorry i've gone on so much, basically, what are my chances of getting a refund? I just wanted to know what the consumer rights are for ordering an item, and having it delivered date and not even the item i wanted!

Hope someone can help, as i would like to be able to mention some rights to them if they start becoming awkward. x

    The company is in Australia which limits your rights somewhat

    You could try asking your credit card company to arrange a charge back as you are in dispute with the company concerned. You might be lucky !

    You can also make a complaint on the Australian Competition and Consumer Commission, probably a bit like our trading standards. Link Here

    If it is a Visa debit cards then Visa have a process for charge backs you need to go through your issuing bank. If they deny knowledge ask to speak to a supervisor some bank staff seem ignorant of this process

    Perhaps they mixed your order up with someone else's. I'd be inclined to make a quick phone call to the Australian number (buy a phone card if you want to do it cheaper than BT) and speak to a human about it.

    I don't know when Easter is in Australia (actually I do ;)), but if you ordered the hamper to arrive on 3rd May they still have a couple of weeks to go.

    Ive still heard nothing, however I am going to ring the bank now and try and get a chargeback. wish me luck, and thanks for all your help x
