Letter from LloydsTSB on my charges claim!

Hi,

I have recieved a letter from Lloydstsb explaining that my case for bank charges refund has been ruled against in court and that if i dont reply to their letter within 8 weeks my complaint will be closed! Is it worth writing to them and asking for my complaint to remain open??? If so whats a good excuse to give them for keeping it open???
Any suggestions greatly appreciated.

    You could do, but unless your in financial hardship there isn't really much point as you'll never see any of your charges back. Despite what was said on here for years about everyone getting there money back and having a big ol' party, is actually turned out that was a complete farse and a waste of a lot of peoples time including, i'm sorry to say, your own.

    Matt, have you actually read the judgement? It doesn't quite exactly say that, but it does state that you cannot challenge the level of charges under UTCCR 1999 and that they are not penalties in law either. It did not say that the charges were fair under UTCCR 1999 but any claim that is made today MUST be very much individualised and not templated as it was in the past.

    Has anyone actually won any charges back other than for financial hardship claims since the supreme court ruling in November 2009?

    (individual, one off, small goodwill gestures excepted)

    The Govan Law Centre case is due to be heard in June 2010. At the moment, applications are going in with regards to amending POC's which as I am sure you can appreciate are being defended by banks. Furthermore, banks are applying to have cases struck out based on the November Judgement.
    So to answer the question, no one has been to court and won in court since July 2007(stop forgetting when the stays were imposed ;) ).
