No you both have to be doing paid employment for 16hours plus per week to get the childcare element

No that is incorrect if one of the spouses is incapacitated I am sure that there can be a claim put in for childcare element of TC. I will see if I can find a link.
  • If you're part of a couple

Generally you and your partner must both work 16 hours or more a week to claim help. Only one of you has to work 16 hours or more if one of you is:
    • ill or disabled and claiming disability benefits

Yes we get the childcare element now as im working 16hrs and hes disabled, Just wondering as im not disabled would my carers class as working. We can claim the disability element of WTC if he works but then will lose the childcare so no point
According to my link one of you have to work 16 hours, so that would not include you caring role for CA.

    Hello

If you are working with a disabled spouse I think you should get the severe disability amount of £1075 approx, assuming he is on higher rate DLA I think.

If your husband was to work then he would get the disability element of £2570. nor sure if that is with the £1075.00 on top or not.

It depends on how disabled he is as to what you/he would get. Might be worth looking into.
