They didn't say that at all. They set a level that they would not take enforcement action in the hope that Credit card providers would self regulate and in that way create competition in the market. They set a £12.00 threshold for enforcement save for companies that had exceptional factors, ie Egg.
That was not to say that legally, credit card providers were acting fairly. It simply meant that the OFT would not seek enforcement through the courts.0
