Tax credits

I have recently discovered that SMP can be deducted at the rate of £100 per for a max of 39 weeks. When I renewed in 08/09 I was not aware of this and although I renewed over the phone to advise did not give me any info they just took our earning and that's it. I have contacted the tax office who have passied it over to HMRC who have agreed that there is an underpayment of £975. However they will not pay it as it was a previous tax year. Can I appeal. Any advise would be great!!!! Thanks

  • You could appeal, but it could be argued that it is your responsibilty to read the forms which states that you can deduct £100 off SMP.
