Rbs charges claim advice please :)

STARTED CALIM BACK IN 1997 WHEN THEY OFFERED ME A REFUND. I ACCEPTED BUT THE CLAIM WENT ON HOLD BEFORE I HEARD ANYTHING ELSE. i MADE A COURT CLAIM BAK IN 2008. i HAVE TRIED TO CLAIM FINANCIAL HARDSHIP WITH NO LUCK KEEP SAYING NOT ENOUGH INFO (ON MATERNITY LEAVE WITH CCCS AND THEY ARE TAKING ME TO COURT TO GET CHARGING ORDER)
CAN ANYONE SUGGEST MY NEXT MOVE? DO I CHASE UP THE COURT CLAIM? I SENT ORGINAL REFUND LETTER BACK TO THEM BUT THEY SAID NOTHING. I'M ON THE WAR PATH NOW PLEASE HELP ME TO WIN MY WAR :beer: SUGGESTION ETC PLEASE!

    Can you clarify that you started the claim in 1997 or 2007?
    What are the terms of your stay with the county court?
    I have not worked for NatWest Bank since February 2009

  • I had a final reply from them, was very rude indeed, will never go back to them. I am in the process of going to the courts now, they filed a defence but it says on the MoneyClaim website that it will be transferred to a local court - still yet to be done though from months ago. I have chased them up.

    RBS told me pretty much to F*** off and stop writing to them as I am not getting a payout from them.

    I was charged £2000 in a year because of their consistantly bad ways of working. Yet this wasn't taken in to consideration. Baring in mind that the FSO/FSA stated to the banks "Somebody who received more than £500 in charges in 12 months, this should be taken as immediate indication of financial hardship"

    Give them all I could give and still said "no your not in hardship" The cheek they have too when the public own them they charge us!!!

    I heard that Virgin Money were trying to buy them out anyway, not sure how good they will be on the high street, but Virgin Media are great for broadband haha.

    The wording of the waiver was that it should be taken as "indicative of financial hardship". It did not say that it was financial hardship. Proof of financial hardship was required and is still required on current cases.

    Give them all I could give and still said "no your not in hardship" The cheek they have too when the public own them they charge us!!!

    What is your POC(particulars of claim)?

    If it matches their other financial products then it will be fur coat and no knickers.

    Virgin have a superb brand which people follow. However, when you look at their ISAs and pensions, they are amongst some of the worst available for features and costs.

    I originally wrote to Drummond House in 2007 (I think) asking for my charges back, was told they were on hold pending the court decisions etc.

    Then I found out we could claim under hardship. You may or not believe the amount of time I have wasted on RBS in phone calls.

    I had an agreed overdraft of £800 which I was managing fine, then my partner left work due to illness. For a few weeks I had to subsidise them and lend money etc until they got Statutory Sick Pay. During all this and me lending money, I was slipping further out of this Overdraft and RBS wouldn't allow me to increase it. I spoke to RBS in Farnworth (where my account was) and informed them I would like a repayment plan of the overdraft to be drafted up, this was done on more than 1 occasion. Due to the ineptness of RBS, the 1st signed agreement was lost, the 2nd time, they agreed then declined it? and the last time I sent all the documents back again but they said "we have no record" even though I was quoting reference numbers. Apparently on this last time the individual who scanned the agreement on the system, put it in the wrong way so it appeared as blank pages.

    So as this is continuing to go on, the Overdraft is getting more and more overdrawn due to charge after charge for being over and Direct Debits failing. As this is continuing to escalate out of control the amounts for each repayment plan is getting more and more. During all this going on - we also lost out on important Overtime too.

    I lived with my mum at the time all this was happening and paying £200 a month in rent. On top of this I had my car loan, £130 a month, Petrol costs of £200 a month, then insurance, food, Mobile/Broadband bills etc I was left with about £200 to myself for the month. As I was struggling so much to sustain both myself and my partner I took out a £600 Pay Day Loan (would never do it again!!) which has left me in a bigger situation that I was in with the Overdraft.

    It was at the point all this was going on that I decided I needed to try and get my charges back, competed the form and explained everything and RBS said, sorry your not in hardship as you still have money left at the end of the month.

    So I was back to square 1, I needed to do something to reduce my outgoings and the only option was to go to a Debt Management Agency, who I am with now and they are paying RBS and all other lenders back.

    I still think I am due some form of return from RBS considering how they have treated me. Even if they use it towards clearing the balance from the "defaulted" account I had with them.

    I am with Barclays now and they are a fantastic bank. It might only be a cash card account but I still got a Visa Debit card and can do Direct Debits etc.

    Just feel like RBS let me down tremendously, and the fact that the public own 60% of them, the government should say, as your majority shareholder, the public should have all charges from X date to X date refunded immediately.

    This may then start to put the banks back in good stead with us, they have had a cushy ride for far too long, bonuses that are too big, which they get even if they F*** up!

    In hindsight I would have written to them but that is not to say that what you have written is not any clearer than it is.

    Do you still have the paperwork and details because if you are going via the FOS then you need this and I personally think that the FOS WOULD take a view certainly on this period of time, ie that you have tried to resolve this with RBS and they have been inept.

    the timeline of all of this is going to be important when you go to the FOS

    I would agree on that specific point in regards to the £200.00 a month spare.

    I don't agree with your viewpoint whatsoever but I understand yours.

    I don't think you understand the whole picture re bank bonuses but I am going to steer clear of it.

    I think you need to focus on the period in which payment plans were agreed, lost and declined after agreement. If they did refund charges during that period then I think and suspect that the FOS would decline it. However, if they didn't then I would focus on that period of time since you have made the bank aware of the circumstances and have tried to do something with the bank.

    the stay in court was forthwith (on CCJ) then they applied in 2008 for application for charging order then in March they sent application to court goes to court next week :mad: I did send in N425 form doe re-determination but thats being held on the same day...

    was 2007 sorry!

    have spoken to rbs sonce and got no where passed from a 2b but said to write letter to customer reponse centre. which i will do soon
