Capital One Harrassment

Hi, just thought I would share this piece of advice about Capital One as I'm sure I'm not the only person tearing their hair out over them.
I currently have an agreement through Payplan to pay my creditors an amount each month until my debts are cleared (in 4 years). I started this agreement back in February. All my creditors have accepted my lower payments except Capital One. I have had dozens of letters, and even more phonecalls from the collections dept in India asking that I pay my arrears immediately of £128. I refuse to as I pay them £22.89 per month through Payplan until I have paid my total balance of £1,200 to them. They ring to say they are not accepting my £22.89 each month as it's too low (and yet they are actually accepting the payments because they show on my statement :mad: ) I just could not get through to them at all that all I could afford was what I was paying ! So I put together a letter stating my problems with Capital One and also that they still call my home number rather than my mobile and sent it to customer services.
Today I got a phonecall again from collections asking for the arrears to be paid today. I feel like playing a recorded message to them stating what my situation is. I said to him send my account to your external debt collections agency I would rather deal with them and he said....wait for it....."I look forward to hearing from you" haha ! Then lo and behold I got another call but on my mobile in reply to my letter I sent. She was a very helpful lady who said my home number had now been deleted and all calls would be to my mobile. The best bit comes next. She said that my income and expenditure had never arrived at her dept and that's all they needed to accept the £22.89. It had gone to the collections dept but that was the wrong place and that if I get Payplan to send it by fax they will assess it all over again ! Also that the arrears and charges since Feb she has cleared off as of today whooppee !
Sorry that post was so long.....but bascially if you're having the same issues with Capital One DO NOT contact the collections dept as they never listen and never take notes but ask to be put through to the Specialist Support Unit and they will take a completely different view on it. She even said that the collections dept don't know what they are talking about sometimes !!!
Anyway I hope that has helped in some way. I really thought that I was going to have to visit Capital One's head office soon and bomb the place

I had loads of trouble with Capital One, then all of a sudden a random payment plan got formed (for less than I was offering?!) with all interest & charges frozen

no not the problems you are having
but cap 1 have been the best with me
they stopped all interest as soonas i mentioned payplan (b4 payplan contacted them) when i was sending them token paymenets of a quid......
the rest have been asshoes though
Debit was £64k (light bulb Feb 05)
Debt now 60K Dec 07 DFD= nov2019

I've found them to be ok, in fact they sent me a 'very understanding' letter.

Morgan Stanley are a compete bunch of bar stewards. They have refused to take my home number if their records and have threatend to look my work number up and call me there too. They make all sort of promises to try to get more than you can afford out of you. They even suggested to me that I should borrow money elsewhere to pay them their £59 so that they wouldnt default my account. I refused. They hve told me that they are going to phone me every day until I agree. I would love to pay them but they dont seem to understand that I cant afford to !!!0 -

The DFW forum frequently advise to get caller ID. I'm on this from Wednesday. Why not give it a go. I'm hoping it will help me. I can't stop them ringing my mobile though. I get numerous messages asking me to contact Claire, Marcus, Robbie etc. I'm dull enough to keep answering my answerphone messages.0 -

Thanks. I have caller ID at home and on my mobile. It's more the fact that when they ring the house I am normally not around and its them hassling my wife rather than me. I am happy to take calls on my mobile but thats not enough for MS. They say part of the t&c on my credit card is that I have to give them my home number. I can't see this anywhere on their website.
I was getting hassled by capital one too but they soon stopped when I told them that ringing me at 9am on a Sunday morning and waking the kids up was not on and that I considered that this was harassment under SECTION 40 OF THE ADMINISTRATION OF JUSTICE ACT see http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=03_harassment for more information on this. I might try it with MS too.

Report them, they are not allowed to harrss you like this. Refuse to talk to them and get them to put everything in writing. What I do is this:
Stage one: I'm nice and cooperate as far as I am able.
Stage two: I start to tell them that I would pay them if I was able.
Stage three: I would tell them to communicate only in writing. NB This would not be a request!
Stage four: I would ask them to hold on for a bit and then just go about my normal business. Every so often I would check to see if they're still holding.
Fortunately in my case it hasn't got as far as stage three but if it ever did, BRING IT ON!!!!!![strike]-£20,000[/strike] 0!0 -
I missed a payment with capital one a few months ago and had phone calls every day (even weekends) asking when I was going to pay, they wouldn't listen to me so in the end when they rang and asked for me I just said 'sorry, she's not here right now, can I take a message?' they just hung up! Another thing I did was not speak when first answering the phone and they'd hang up thinking they'd got through to an answering machine!Kate

I have has around £1,000 in chargers from Capital One over the last 6 years, non in the last year though, gonna go and claim the whole lot back! Serves you right Capital One you've treat me and the poor people above like fools for too one. Greed gets you no where!0
