Iphone Delivered in Error

My wife ordered an iphone from Vodafone in December. This order was accepted and she was due to get the phone in January. Just prior to the phone being issued she received an email stating that there was a problem with the order and that it would be cancelled. She called Vodafone, initially they told her that the email may have been sent in error and that she would probably receive her order and a further email would be issued confirming this.
She called again just prior to the delivery date as she had not had any further emails. When she called she was informed that the order had been cancelled and she would have to order again. She did this and that order was processed with no issues.
On the day that Vodafone released the iphone in January there were two phones delivered. Having checked her credit card statement she was only charged for one of the phones. She contacted Vodafone at the time, via letter and the helpdesk. Vodafone arranged for a courier to collect the additional iphone but the courier did not arrive.
She complained to Vodafone about this but no one seemed to know what to do. She has subsequently tried calling Vodafone on several occasions regarding this. They kept transferring her to various departments who told her they did not know what to do or they hung up on her after keeping her on hold for long periods. As it stands she is not willing to waste much more time trying to return this item.
We are going to send a further letter to Vodafone stating that they have 7 days to respond and that collection must be arranged within one month of the date on the letter. This should be at a mutually agreeable time and they must reimburse us for any time that has to be spent arranging collection, such as time off work to await a courier. If they do not meet these criteria would we be within our rights to keep the iphone that was delivered in error?
Also the phone was sent from England but we are in Scotland, is it Scots or English law that covers this?

You're being generous to Vodafone. I think it is classed as 'unsolicited goods', and as such, you can keep it.
Or..... Seeing as I live near their Newbury HQ, you could forward it to me, and I'll *make sure* they get it back

This only applies if the company send the goods that havnt been ordered with the intent to invoice them later. This isnt what has happened and is just an error but i agree the the op is taking reasonable steps to send the goods.Back by no demand whatsoever.0 -
Sounds like you've made MORE than enough effort to allow them to collect the goods at their cost. If they can't be bothered to collect it, then that's their problem!

Is it that hard for someone at vodafone to decide what to do about it, one of they're employees could get a big thankyou for taking the inititiave(sp) for getting the iphone returned0

After all your effort if they still haven't arranged to pick them up then just keep it for a few months and sell it/give it to someone else to use if they still haven't done anything.0
