Hi
I work 29.5hrs a week, 5 days a week, as opposed to 37.5 (as I used to)
I have been informed that my entitlement for this year (jan to december) is 127.50 hrs (17 days). I thought that my entlitlement was 20 days as I work 5 days a week
see here http://www.direct.gov.uk/en/employment/employees/timeoffandholidays/dg_10034642
however I am being told that they are calculating my entitlement based on hrs and not on days, even though I am salaried?
However even if I calculated my entitlement by hours on this website http://www.businesslink.gov.uk/bdotg/action/layer?topicId=1079427399
it says that I am entitled to 165.2
I have also found an email sent to me when I changed my hours that I was going to be entitled to 4/5th of my holidays? I dont understand why it's calculated at 4/5th either
Can someone advice please
many thanks

Do you work the same hours each day.
If you do then they should just use the normal holidays
Min holidays is 5.6 weeks so 28 days for a 5 day worker
This can include bank holidays.
For hours it should be 29.5*5.6 165.2hours again that includes bank holidays
What holidays do full time workers get?0 -
You are assuming you book 7.5 hours per day to get back to 17 days. You will only book the hours off you would have worked, so 29.5 hours for a week, not the 37.5 hours as you are using as your calculation.
If you normally get 20 days plus bank holidays and they are going to given you 127.5 hours plus bank holidays i'd smile and say thank you. 127.5 hours / 29.5 hours is 4.32. 4.32 weeks is 21.6 days pro rata.
Your equivalent of 20 days (ignoring bank holidays) should only be 29.5 hours x 4 weeks = 118 hours.
Unless you have to book bank holidays out of the 127.5 hours?, in which case, yes it's wrong."On behalf of teachers, I'd like to dedicate this award to Michael Gove and I mean dedicate in the Anglo Saxon sense which means insert roughly into the anus of." My hero, Mr Steer.0 -
You're entitled to 28 days (including bank holidays) for a full time employee.
At 29.5 hours a week, you work 78.67% of the normal hours, so should get 22 days (including bank holidays). A day is 7.5 hours obviously, so 165.2 hours.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -

You work 4/5 of the fulltime hours so your leave entitlement should reflect this.
Would you expect someone that worked say 2hrs per day 5 days a week to be given the same holiday entitlement as those working fulltime hours?0 -

It's about what constitutes a day for the individual. So someone working 2 hours a day five days a week gets the same number of days holiday as someone working 8 hours a day - but the days are different lengths.
If they want to work it out in hours, then those hours will be spent on holidays at the same rate as the individual's normal working day.0 -
We need the OP to come back and answer the questions about hours, Bank holidays and full time worker holidays.
Previous thread the hours were going to be 5hrs Mon-Thurs + 8hr Friday so something has changed since that is 28hr not 29.5hr.0 -
hello all and many thanks for your replies, although I m still confused
I work 5.5hrs a day 4 days a week and 7.5 hrs 1 day a week (total of 29.5hrs a week), I can choose which day I can work the long day.
It does not effects BH as I still get them all off. As a full time employee 37.5hrs a week I used to get 20 days holidays + 8 BH
If you have more questions just please ask.
many thanks again for taking time and replying0 -
If you work different hours how can 127.50 hours =17 days? If you take all days holiday on a 7.5 hr working day it's 17 days. If you take all your holidays on a 5.5 hr working day it's over 23 days holiday.
37.5 hrs x 52 weeks = 1950 hours, 20 days holidays = 150 hours so c. 0.0769 holiday per working hour
29.5 hrs x52 weeks = 1534 multiply by the holiday multiplier 0.0769 = 118 hours or thereabouts
So you've actually done OK I think0 -
You need to get them to tell you how they have worked out their numbers in detail.
If the normal full time holiday is 20+8 bank holidays then you should get
5.6 weeks(28 days) paid total since you work 5 days.
If you are salaried(12 monthly payments) then because of your variable hours it can get a bit more complicated.
Of those 28 (5.6 * 4) 22.4 would be normal 5.5hr days and (1 * 5.6) 5.6 would be 7.5hr days.
If done by hours you need to take a combination of 5.5hr and 7.5hr days to use it all up.
NOTE that this should result in a minimum of 5.6 weeks off.
lets have a guess at what they have done
So you should have 165.2hr they came up with 127.5hr
Assuming they have taken off the 8 BH they used 37.7hr cannot see how they got that, its an average of 4.7125hr.0 -
Taken from the ACAS website:
How is a part-time worker's holiday entitlement calculated?
Part-time workers are entitled to the same holidays as full-time workers,
calculated on a pro-rata basis. For example, an employee who works three
days a week is entitled to 16.8 days’ paid holiday – their normal working
week multiplied by 5.6. An employee who works four days a week is entitled
to 22.4 days’ paid holiday – their normal working week multiplied by 5.6.
So in your case yopu are entitled to 5.6 weeks x 29.5 = 165.20 hours
This of course includes bank holidays.
