Agricultural Workers Occupancy Condition

Hi Everyone , Just wondered if anyone could help. I/ we have seen a house with is just within our price range. However it is being sold with Agricultural Workers Occupancy Condition attached to it.
What we were wondering is, Whats the minimum that needs to be done to comply with this. It has 3.5 arces and we did in the near future want a smallholding. So we would be happy to have animals, ie pigs sheep, chickens, bees, possibley goats oh and fruit and veg in polly tunnels.
If we are getting a income from these things would this qualify us for the Agricultural Workers Occupancy Condition ?
Hope someone can help us sooner rather than later as, we need to make a decision very quickly.

You need to be working in agriculture, not to be running the property as a small holding. So anyone working on another estate would be eligible.If you've have not made a mistake, you've made nothing0 -

Yes I know it has been discussed before , but most of the posts are talking about getting the ban lifted.
I rang the agents and she just sand you had to have a income from farming etc, Well we would be recieving a income, all be it a small one.
If we planted a whole load of christmas trees, we would recieve a income just not straight away. Does this make sense ? Wouldn't want to build on it or sell it, Just want the animals and to be as self suffient as possible.0 -
Not from a legal point of view, but just looking at this logically: if it was that easy to get around the agricultural occupancy condition then this house would not be cheaper than any other in the area. Also, people wouldn't be so keen to get rid of these conditions. I think RAS probably has the right idea.0

I could be wrong but I thought that your main income had to be from agriculture (so you can't work in an office and water your crops in the evening and weekends) and I also think, probably from reading threads here, that agriculture is quite tightly defined and your christmas tree example would probably count as horticulture rather than agriculture.0

You really have to look at the precise wording of the condition because this will make a difference. Councils have tightened up the defintions over the years to avoid people hobby farming and other abuses - but if this one is an old one which is not clearly worded it is possible that you might get away with it.RICHARD WEBSTER
