Unsigned cheque?

Can a company cash an unsigned cheque please?Can anyone tell me my rights regarding this with my bank?

    I wouldn't of thought so. The signiture is the issuers way of authorising the payment as genuine.

    They may get through in a big bundle of cheques but the bank would have to refund the money if you complained. They can easily get a copy of the cheque.

    when i was a cashier - we used to have to check this - but then the bank i worked for sent them off - they would get rejected if any were unsigned ect
  • If the bank pays out on an unsigned cheque then they are acting outside their mandate and they must refund you - t'is the law! It's then up to the bank whether they want to try and get the money back off the person/company they paid out to (or even if they can).

    the bank should not be able to process a cheque that isn't signed - it's like they can't process a pre-dated cheque.

    They can process a pre-dated cheque ok - if no-one checks the date it'll go straight through, I've known it to happen.

    They should check there is a signature though.

    Actually they can process a pre-dated cheque as the minute you write it you are agreeing to pay the amount and it can be banked regardless of the date.

    Unsigned cheques do slip through at the counter but are usually returned to the drawer from further down the clearing process.

    your bank will have your signature on mandate and will be able to get a copy of the cheque and check this against your mandated signature. contact your bank and explain you did not sign this cheque and they will look into it they will deal with it as fraud. has your cheque /cheque book been stolen? and have you reported it as such?

    Yes, they will recompense you if they are satisfied that the signature is not yours.
