the problem we have is although me and hubby are married our financial affairs are not. [STRIKE]We[/STRIKE] I learnt a long time ago a valuable lesson of joint accounts and hubbys self employment. Sounds really bad but he looks after his business overheads and van (our only vehicle) and I look afer the household essentials. It's the only way it works for us!
This is why we have to submit separate applications (other than the fact our combined debts are very near the claim limit.) You can imagine hubbys form shows no priority bills or food just his van and a few other outgoings he considers essential plus this matches his income from Self Employment (virtualy none) and his seasonal job. My form shows the priority expenditure and food plus a few other bits which matches the income from IB benefits / tax credits exactly, its tight but somehow we manage.
How do I complete the forms online under separate circumstances?

Thank you for your message.
You mentioned that you are in a DMP with a fee charger. Have you considered going to a non fee charging debt advice charity such as CCCS? This way, the extra £30 per month could be going towards your debts.
Creditors can issue default notices any time after the terms of the original contract have been broken. Usually this happens after you have missed three to six payments. It might be that they are thinking about passing the debt on to a debt collection agency and legally they cannot do this until a default notice has been issued. I'm considering taking over the dmp myself and am in the process of contacting creditors at the moment.
I'm not sure if I have conflictingadvice but some posters on another thread have directed me to the ICO guidance which states that defaults should not be registered more than 6 months after default took place as this is considered unfair. As LLoyds have added the notice 36 months after initial default do you think I have any grounds to get them to backdate the default to 2007.
And one more question - do late fees/charges stop after a default is issued? (I know interest may well still accrue)

You cannot do a joint DRO so you would have to apply seperately if you fit the criteria.
It may be advisable to call for an appointment to discuss this in more depth with a counsellor rather than do it online.
The counsellor will be able to work out a budget with you and explain how to proceed if the best option is a DRO.
If it is your best option, you will need to apply for a copy of your credit reference file to check that you have all your creditors listed.

Hello I have been taking advise from a CASHflow advisor and negotiating pro rata offers all accepted apart from Capital One I have complained to the Financial Ombudsmen they have refered me back to Capital One so its on going but they still send me the same letters that say nothing about my pro rata offers is this a normal problem what should I do next0

With regard to the late fees and charges, usually they do stop but there is no guarantee they will. It is at the discretion of the creditors.

Hi Sue
All my creditors have been written to with an offer of payment just waiting now for replys. Can you tell me if you have any experience with Vanquis they are constantly calling me. I have ignored the phone calls all day but am becoming annoyed with them as dont seem to be listening to me.
If I send them a letter requesting take my number of databas should this do the trick or are they difficult?

Just to say... I am in a big mess with debt and have discussed my
situation on this website over the last few weeks...
I have a debt management plan ready to start on 1st Sept 2010 through the CCCS.
My experience of setting this up with the CCCS has so far been nothing short of brilliant.
These people are real experts. They are understanding, realistic and have time to answer questions and concerns.. and is all free.
I can't overstate how much I appreciate the help of everyone on this website and the staff at CCCS.
I have no idea how I could have coped otherwise.

Can I Butt in, I've heard nothing from CCCS. They sent me an email on 23rd, or some whereabouts, of July, and nothing since then. My first payment was supposed to be 1st August.0

If you have sent Capital One a copy of your income and expenditure and an offer of payment based on what you can realistically afford, then you have done all you can.
You cannot pay them money you do not have, so do not be pressured into paying more if you are not able to.
