    I have contacted Equifax who have gave me a phone number for the creditor saying I should contact them to discuss.
    What should I do ?? Any advice on the best way forward for me would be greatly appreciated. Thanks in advance


    Hi kjnealon and thanks for your post.

    It looks like you’ve already had some useful replies on your other thread.

    You should definitely discuss it with the creditor and it may help to provide proof that you moved well before the date that the debt was taken off.

    It may be a lengthy process but you should be able to get it removed from your credit file and hopefully they’ll be able to track down the person that took the debt out.

    I really hope you can help me with this one.

    We decided to emigrate to New Zealand towards the end of last year. I thought I had planned it all fairly well and identified three main things that needed to happen in an ideal world:

    - Our house selling
    - My wife's business selling
    - a large tax rebate arriving in time

    We had some manageable debt in the UK and I was hoping that the equity in the house and the tax rebate would help start us up over here and clear all UK debts. I had contingencies in place to cover one or two of those things not happening (i.e. use house equity to clear business overdraft if business didn't sell etc etc). We put the house and business on the market as early as we could. In the end, what happened was that I got offered a job much more quickly than I thought so I had to leave the UK before my family. In the meantime, we found buyers for the house and business and although we were effectively covering two lots of living expenses (including rent here in NZ) we thought we could just about cover it. Then in quick succession the buyers pulled out of both the business and the house and there was no sign of the tax rebate. We were then left in the situation where I was paying a mortgage of 1100/month in the UK and the bank sold my wife a loan to pay off the business overdraft and buy her out of the lease on the business premises (it was a small shop). This added considerably to the monthly payments we had to make. We dropped and dropped the price of the house and have just sold it this week for just less than the value of the mortgage. In the meantime we have maxed out our credit carsd to keep us going. The tax rebate eventually came in but also had to be used to continue making payments. I am now left with around 44k of debt in the UK (credit cards, bank loan, overdrafts, one store card) which I am sending money back to cover from here. I am pretty sure that my credit rating will be poor as I missed a few payments through cashflow issues and then getting behind (I am up to date now). I can make regular payments back to the UK to cover all my creditors as things stand but this leaves me very short now out here and I will be very vulnerable to changes in the exchange rate. We have nothing as security now and cannot Afford to come back to the UK. I am not a resident here yet so I think my only option is to do something that is UK based? I owe this money and take responsibility for that but if there is a different way of paying it back then I would really appreciate some guidance. Any assistance much appreciated.

    It’s very difficult to give advice without knowing more about your situation.

    Provided that all the debts are UK based and they are not business related, we can help. I’d recommend that you call us on +44 113 297 0126 to book an appointment with a counsellor. Lines are open Monday to Friday 08:00-20:00.

    It’s best to gather together information about:
    • Your income
    • Your expenditure
    • The creditors you owe money to

    It may be possible to refer you directly to a counsellor for immediate advice or we can arrange for an appointment to be booked at a time convenient for you.

  • We have made some mistakes in the past and have managed to build up debts of around £25,000, we are now struggling to repay even the minimum payment amount. we haven't missed any payments yet but are worried how we will continue to cope. we would be very grateful of any advice you can give
  • Hello, I hope someone can help with my position. I had a debt of £1500 which I wanted to defend as I had charges etc on and was disgusted in the way the bank threw me to the wolves with the debt recovery companies. I tried to follow the advice on here and when a company hounded me I sent the CCA requests and informed me not to contact me only for them to stop but another debt company took there place, in the end I just stopped answering any mail or calls on the subject. Eventually two months ago I got a court proceedings letter from Bradford County court. I replied to defend this. I am working abroad and could not keep on top of my mail and only yesterday found out a defualt judgement was made against me for £1666.

    With working away now I want to clear this mess from my life. I rang Arrow Global only to be transfered several times and eventually speaking to someone at Fairfax who had the file. I said look I want to settle this can we come to an agreement. She haggled and we agreed on £1100. She said she had to have confirmation from her client who is Arrow Global. I said when they give you the OK can you send me a letter stating "full and final settlement for £1100". She said she thought the letter would be worded as "short settlement ". I see on the forum some people are saying this is not a good thing ? Keeping in mind I dont want to frighten them away as I am getting to old to have the Bailiffs at my families door, Could someone please advise on how I proceed from this point. Fairfax indicated they should have a decision from Arrow Global on the settlement for Tuesday 4th Oct next week.

    Well I think I have messed up here and just want it behind me without paying this ridiculous amount. At one point one of the debt companies offered a settlemnt of £400 ! I refused because I thought I could defend this whole claim but taking a job away has cost me the ability of keeping on top of things.

    Please advise it will be greatly appreciated.

    I currently need some help.

    I lived and worked in France for 4 years but unfortunately got made redundant over a year ago and had to move back to the UK (which is where I am now).

    I currently have the french tax man after me for unpaid tax, I have tried to speak to them and 'make them an offer' but they decided to hand it over to a debt collector without further delay. The debt collector is due to enter my apartment in France next week and take assets. As a result of the tax man situation my french bank account got frozen, which meant I couldn't pay my mortgage to the french mortgage company I took my loan out with. Now I've gone in to arrears on my mortgage in France, I can't pay my charges or extra loans I have with another bank in France, everything seems to be getting out of control! Again, I have tried to contact the people I have my mortgage with but they haven't got back to me recently.

    I have just put my apartment up for sale, but with the way things are the market seems to be very slow.

    I was just wondering if there was anyone I could speak to in the UK who might be able to help me with the problems that I have?

    Also, I have just recently been told that I might be made redundant from my job in the UK, so making payments to France each month might get difficult very soon.

    I am thinking of going bankrupt as I owe about 24k and a disposable income of just under £100.

    I wanted to do a debt management plan but was told the creditors probably won't accept.

    If I do go bankrupt what would the take of me?
    Really the only things I own worth anything are my car worth about £700 my tv which was a present from my parents which was £380 last year and my xbox and games.

    I did have another idea instead of bankruptcy but I'm not sure if its possible,
    I wanted to set up a dro for 15k of my debt and then set up a dmp for the rest.

    Any help appreciated
  • I must have had some bad karma from somewhere.

    Just as I thought everything was starting to go okay. My first payment for DMP was paid last month and my second payment was due today.

    Just checked my bank account (I asked Yorkshire Bank to cancel my pay payl direct debit last week), Guess what -- theyve cancelled all my direct debits including the one to DMP. I dont want my plan to be cancelled.

    My question is how do I make a payment direct to them, Im in severe panic mode here.

    Hello gmt56565 and thanks for your question.

    If you want to settle the debt at this stage, it’s important that you’re happy with the wording of the letter. You need to ensure that they won’t chase you for the remainder and they won’t sell the remaining debt on to another debt collection agency.

    It’s also a good idea to ask them to mark your credit reference file as ‘satisfied’. Make sure that you keep copies of everything that you send and receive.

    Unfortunately we are only able to offer advice on UK based debts as France has different debt laws to us.

    I’d recommend that you contact an advice agency in France as they may be able to help you.
