Hi lindylou4711 and thanks for the update.
Unless your mother has CCJ that has been defaulted upon there is no warrant of execution.
If you are in any doubt about the CCJ ring your local court to discuss this, as they are the only place that can issue a warrant of execution.
If your mother needs any further advice please call free Helpline on 0800 138 1111. We’re open Monday to Friday 8am - 8pm.
I hope this helps.

amagicwandplease wrote: »Hi,
Just about to enter into a CCCS dmp as mountain of CCs is getting me down and after 6 months struggling on maternity leave I feel its the only way we'll ever get out.
When I first read through the forums I felt great about it but since I've 'pressed go' I am now getting cold feet about stopping the payments as I am not sure I can cope with the threatening letters and phonecalls I have just been reading on some other threads that people seem to get, especially when I have about 15 creditors to deal with
O/H is great but theres only so much he can do as its all of my debts (he still has his own to deal with in addition to helping with mine!) so I feel Im going to have to fight this one out alone.
Can I reasonably request somehow that I am only contacted in writing or if I call them initially will it help? We've been managing only minimum payments for so long I need to do something but I am really frightened about all of the over limit, late charges and interest which will be added on for the next few months and if they dont accept we'll just be worse off.
Are there many creditors that really wont accept reduced payments and will they be less likely if I am way over my limit for missing this months payment already? I know it'll happen soon anyway but it just feels like such a big deal to stop payments this week when I dont know how long it will take CCCS to step in and help me sort this mess out
Really looking forward to it all being sorted and getting some sleep again, however I feel that may take some time!!!!!!
Hi amagicwandplease and welcome to the forum.
You are within your rights to request that creditors only contact you in writing. You can also request that they remove your telephone numbers from their records.
You should write to them and ask for this and send the letter recorded delivery.
Only your creditors can decide to accept the reduced payments, you might find it takes a couple of months for them to do so, once they have seen that you are making your best efforts.
If your partner has debt issues to it might be worth looking at your situation jointly.
We’re always here to offer support and guidance once your debt solution is in place.
I hope this helps.

Hi, My OH took out finance for £750 in October 2004 on a buy now pay later deal. He did not make any payments on the account within the 12 months so a direct debit was set up to repay the debt plus interest. However one payment defaulted in March 2007 and according to the statement (attached) a two charges, default sums L1 & L2 have been applied to the account every month even though payment went through OK until Nov 2007. No letters were ever received to notify of these charges. In November 2007 when the payment defaulted we got a letter stating the outstanging balance I called them to query the amount and requested a full statement. They first sent just a outstanding balance statement so I call a further 3 times to requested a detailed transaction statement, anyway by the time it came an I saw the wrongfull charges the debt had been passed to a collection agency and I was told we would first have to deal with them. ANyway nothing ever got resolved and then we finally received a letter in 2009 saying the debt has been written off. That was the last we heard till last week when he got a letter from Cabot, chasing the outstanding debt. Can someone look at the statement and tell me if they also believe the charges are not correct? Because they have added these charges each month, the debt as gone up and so has the interest. Please any advice welcome, really do not know what to do here.
I have put a star next to the ones that I think are wrong.

Hello, I was wondering if you could give me some advice?
I have PPI on my Argos Store Card. When I had it I was on JSA so I was unemployed. I am currently on ESA because I have been in hospital and am still under the hospital (out-patients) for Pulomary Embolisms.
My Q is was I mis-sold PPI because of my employment status because if I knew I wouldn't have benefited from it, I wouldn't have got it. And now because im 'unable to work' due to me ESA, I still can't use my PPI because it is not really valid ??
If you could give me any advice to get the ball rolling, I would be really grateful.
Thank you, LauraAs of September 2011:Argos - £86.00 - Reclaiming Mis-sold PPI too! ~ Student Loan - £?Natwest ->(CC) - £130.00 (OD) - £212.00 ODLloyds TSB ->(OD) - £1500 OD (CC) - £1179.470 -

Hi jenand8285 and thanks for your post.
Unfortunately I can’t view your statement but the interest and charges would depend on the terms and conditions of the account.
If you’re not happy with the amounts, I’d recommend that you follow the complaints procedure of whoever the original debt was with. If you’re not happy with their response you could escalate it to the Financial Ombudsman.
If you still have written proof that the debt was written off you could send this to Cabot and ask them to stop the collection process until the issue is resolved.
I hope this helps.

Hello Laura and thank you for your post.
I can’t guarantee whether you will receive a refund but it is worth putting in a claim.

I've been on a debt management plan for 4 years now and thought it was all going well. I own my house so don't want to go bankrupt. I recently contacted my mortgage provider, Northern Rock (NRAM) to see if I could re-mortgage to try to clear all the debt but they don't offer this service and no high street lender will touch us because of bad credit/DMP. I decided to contact one of the creditors who on my debt managent plan with PayPlan it says we owe an estimated £2884. As my wife works in debt collection she knows you can get a reduced rate to pay them off if we could get hold of some money as this was the initial plan of Re-Mortgage. When she contacted them they said we actually owe £3665. If this is the same with the other 6 creditors which all say the offer is 'pending' or 'rejected' I am worrying how much we actually owe. On the Pay Plan website it says we owe £23582.74 but this could be a lot higher and take most of my life to pay back. What other options do I have? Or should I stick with the DMP? Any help/advice would be great.0

Hi AlanDobbs and welcome to the forum.
As you’re with Payplan and they already have access to your information you could speak to them about your options.
It’s usually your responsibility to update your balances by contacting your creditors – Your current DMP provider may be taking the figures from the originals that you gave them and deducting the amounts that you’ve paid - this wouldn’t take into account any interest and charges that have been added over the years.
It’s difficult to say what your options are without looking at your situation in more detail. If you’d like us to do this you can visit our online debt advice service Debt Remedy (http://www.cccs.co.uk/ref/drcu).
Alternatively you can ring our free Helpline on 0800 138 1111 to speak to an advisor. We’re open Monday to Friday 8am - 8pm.
I hope this helps.
