    hiya

    just looking to see what options i have as i have a court date next week, when the creditor got a ccj by default as they had not sent info to me for my cpr31.14 request and i failed to stop them getting the ccj, hindsight is a lovely thing,

    so treid to get a set aside, as i said i wasnt sure of the debt and had requested info and creditor said they had no records of my calls to them and thus the judge asked for the info of statements to be sent to me, which finally they have and okay i recognise it but all this and me paying the 75 fee for the set aside could have been avoided if they had replied to my cpr request, so what is the point of doing that request if creditors choose to ignore it???

    so now at my court date what is likely going to happen proof the debt is mine? okay thats fine how to show i want to pay something but i cant afford the likely 300 a month i think they will try and propose i pay as that what was on the ccj paperwork

    so do i have to accept what the judge awards or can i at that hearing put in my offer of payment or do i have to do something like a form after that court hearing im unsure

    the bad thing about all this i had this credit card tucked away but whilst in a depression state during that time i was asked to help a freind avoid losing her home and i paid her mortgage nearly 5000

    and now im left with the debt to pay off - yeah nice freind and me feeling like an idiot but also that i did this whilst in a very depressive moment in my life, of course today i would not do such a silly thing
    but hey thats life

    now today i have to deal with this and need to move on with my life and put this worry behind me what is the best form of action i can do pls

    I know no-ones in till 26th, and theres a backlog, but thought better get into the queue, while I'm feeling brave.
    It looks like in the near future that my money is going to be reduced, and as such will be in financial do-do.
    Bankruptcy is not an option for personal reasons, - the questions I've got going round?

    DMP - Is there a time limit that you pay for eg 5 yrs or is to the full amount paid off or a certai %, and what disposable income would be needed for this

    IVA - I know thats one step from bankruptcy, but would it need to be declared, its just that im in a position where bankruptcy would mean I lose a lot and not pratical for more ways than one, again is there a a certain % of disposable income that you need, and how long would that generall last, and do all or a % of the creditors have to agree?

    what documents etc would I need to proceed with any way

    Hi there,

    Today its finally hit me just how much i need some advice on debt. A few years ago i got myself tangled up with someone who turned out to be addicted to gambling, however at the time i didnt realise this, until all my credit cards got maxed out. Before that id taken out a loan to pay off another ex when we split up so i could keep the house. So this is the position i find myself in.

    I earn £42,500 before tax
    Mortage and bills come to £1200

    Now the bad part:
    I have 2 credit cards and 2 loans.

    Alliance and Leicester loan, took out £20000 in Aug 08, pay £430 a month and have about £12k left to pay

    Alliance and Leicester credit card, £3000 limit, owe £2,974 and only pay the minimum a month which is about £90

    Natwest Loan, took out £25000 in April 09, pay £460 a month and have just under £20000 left to pay

    Halifax credit card, Had £13k limit, owe £11,750 and again pay te minimum a month which is £210.

    I have tried to take out a new loan of £25000, to try and consolidate to lower my payments and pay off the debt quicker, but i have been refused as my borrowing is so high.

    I have a mortgage but have no capital in it.

    I would be really grateful if you could give me some advice over what to do. At the minute, the only way i can see is to try and survive the next 2 and a bit years until my A&L loan is paid off and then try to take out another one to consolidate my credit card debts, but obviously id like to try and start paying more off that off now.

    i know ive been stupid and have been so angry with myself letting this happen to me, but im happy that i am taking control and getting it sorted. A lot has already been paid off, i just wish i could find another way to pay the rest of quicker.

    Electoral Role - 2 years at current address

    I would guess it was the Fredrikson debt collection that did the CCJ as they are a month apart?
    I am also more than sure that i have had other debts, i had a car taken away and credit cards/over drafts with another bank which then had the account closed. But none of these are on the file. these would be going back 6years or more

    If you’re unsure as to what the CCJ is owed to, I’d recommend that you contact the courts to find out. You could be right that it’s Frederickson but it’s best to make sure.

    With regards to your other debts; have you checked all three of the credit reference agencies? That is Call Credit, Experian and Equifax? The details of your other creditors could be registered with another one of these agencies.

    If you have, it could be that the details of your other debts have dropped off your file. If this is the case it would be difficult to track them down unless they contact you. You could check at your previous address to see if they have tried to contact you there – especially if you didn’t inform them when you moved.

    Hi GOLFER and thank you for your post.

    If you are considering offering reduced payments to your creditors, you would need to send them a copy of your income and expenditure as proof of your situation. You would need to offer reduced payments to each of your creditors so that you’re not showing preferential treatment to some over others.

    They may consider freezing interest and charges but there is no guarantee that they will agree to this.

    Although making reduce payments won’t put your house at risk directly, your creditors are likely to go down the standard debt collection process. If they are not happy with your offers, they could apply for a charging order which secures the debt against your house.

    I’d recommend that you get in touch with this so that we can help you to put together a budget and explore all of the options that are available to you. I know it’s not easy, but as DrakesheadLabs has said, it could work out for the better if you consider talking to your wife about your situation.

  • I dont know where to go from here. My marriage broke down 18 months ago and I am left with the house to maintain. After my marriage broke down my spending went mad. I have continued spending and cannot say "NO". I have constantly overdrawn and have to rob Peter to pay Paul and pay back again with interest. My credit card has gone over the limit and I have two loans. I am extremely worried and scared and have suffered with mental health issues for almost 3 years. I suffer from depression and anxiety. I am absolutely at a loss at to what to do. I work hard but for what?

    The first step is to draw up a realistic and sustainable budget that you can stick to. It’s important that you maintain payments to your priorities such as rent or mortgage and utilities etc. You can then offer payments that you can afford to your creditors after that.

  • I recently received a letter from a collections company. From an O2 simplicitry contract i took out last year. I stopped using the phone after a month and forgot about it. Which was a stupid thing to do, but i have always buried my head in the sand in the past, hoping things would just go away. So the collection agents have sent me a letter and i called them, because they text everyday. Arranged a payment plan as i had just started work afterbeing unemployed for over a year. In my xcitement i said i would pay 79 pounds on payday, little realising that housing benefit would suspend my claim while waiting for TWO payslips (thats a different story).
    So i pad my rent knowing that in time my claim would be backdated. But then defaulted on my payment plan with the collection agents. Now they WILL NOT accept a plan even if it is by direct debit, and they are threatening to send bailiffs round. This is causuing anxiety and uneeded stress.

    I recieved an email today saying they have refused 50a month and that included a budget laid out by CCCS and list of my other creditors. I have also put information in a written letter to them as well and they still refuse.


    What are my next steps? Can i petition the original court where the judgement was made as the case was judged in my absence initially?

    You didn’t mention that you received a CCJ initially but at the end of your post you say that the case was judged in your absence. It’s unclear whether or not you already have a CCJ in place and they are usually set over paperwork rather than in person.

    If you do have a CCJ, it’s important that you come to an agreement and you would need to fill out an N245 to vary the instalment order. You mention that you have a budget that we helped you complete. If this is the case, I’d recommend that you get back in touch with us so that we can update this budget and ensure that your offer is realistic and sustainable.

    If you haven’t received a CCJ, it is unlikely that they will send bailiffs as they would need to obtain a CCJ first.

    Either way, I’d recommend that you give us a call so that we can give you more detailed advice. As you are already a client, we will have access to your information and we can advise you fully.

    Is it possible to get some advice, - theres a strong possibility that my income is going to reduce by 50% in a couple of months, at the mo just balancing the books, but is difficult.
    Looked at the debt remedy - suggested bankruptcy or dmp, bankruptcy isn't an option due to personal circumstances, but if I went for a dmp, can the creditors say no, - theres 3 (loan, od, cc) with one company, whilst the others are split between single instutions, - if the dmp was the option to follow is there a time limit for this or does it continue till the debts are paid off ??

    When would it be best to get the ball rolling, when I know if the income is def being reduced - date wise?

  • dec 09 debt (really confused please help)



    Hi I am being chased out of the blue for a bill at Bupa. I had an op there in dec 09 I was with Standard life insurance. I was not aware I had to pay more than my excess £50 and now after emailing them for a copy of my notes they have come back to me saying I owe them £225.25 and that they will not send me my notes until I give it to them and that I owe them this much.

    I had no idea I owed it to them I was never billed or contacted. I have moved but that was 7 months after my op and I was never called either and my mobile number has never changed. So I am unsure what I need to do. I am not sure that they are allowed to refuse me my notes because of it either as I thought under the FOI act that they have to give them to me anyway regardless of allegid debts .

    I do remember once someone saying that if the company has not contacted you for 2 years and or called you can declare the debt vente? something? HELP!!! please.

    If a court date is set, I’d recommend that you attend so that you can put across the point that you have mentioned. Take a copy of your budget tell them how much you can realistically afford to repay each month.
