Hi, I need help with my SOA which I intend sending off to my creditors at the end of the month. Do I just put my salary and outgoings or do I put my OH's as well? Would rather keep OH out of it but not sure legally what I am supposed to do. Many thanks!

Hello mrs skint and thank you for your post.

If all the debts are in your sole name only, you don’t have to include your partner’s income, so it is entirely up to you. You would need to show that they are contributing in some way. For example, if you pay half of the rent or mortgage each, just include a comment that explains ‘partner pays half’. Similarly if your partner pays something in full just put £0 and ‘partner pays’ next to it.

Hope this makes sense, but if you would like some help in putting together your budget, you can use our online advice facility Debt Remedy, or ring our free Helpline on 0800 138 1111 to book a telephone appointment with a counsellor.

    Kind regards,
    Pavan

HI there, i have had a DMP and now a single parent and not working i cant afford so i am wondering if it is in my interest to go bankrupt. I own my own house, which the mortgage is being paid by benefits and ahve two little children under 5. My other thought was to offer a full and final offer to companies and see what happens. I thought maybe i could pay it over 6 months or so.

I owe all together approx £28, 000. This is mainly the interst that was changed on a professional studies loan that i took out in the 90's.

can anyone help or give me some advice on where to go, Thank you

Hi Susankmum and thank you for your post.

You don’t mention who your DMP is with. If it is with one of the free charities such as us, we will explore all of the alternative options that are available to you. It’s difficult for me to say whether bankruptcy would be your best option without knowing the details of your situation.

I’d recommend that you give us a call so that we can look at your circumstances fully and then discuss what your next step should be. You can call free on 0800 138 1111 and lines are open Monday to Friday 08:00-20:00.

Alternatively you can visit our online debt advice tool, Debt Remedy. This will assist you in completing a financial statement and you would be provided with tailored advice on the best way to deal with your situation.

    Kind regards,
    Pavan

  • I have a DMP with Payplan for a remaining balance of £39K. My Dad has kindly stated he will help settle those debts ( only if full and final) he can give me £20 K.

I have contacted some of my creditors today, some were quite helpful and accomodating, others were less helpful demanding full payment. Payplan were unwilling to negotiate at all with the sum I have offered, however, I have today managed to negotiate my debts down to £26K as final settlement. many offered to renegotiate when I had a firm idea of the funds I could raise. I could raise, reluctantly from my childrens savings, another £4K.

I need some advice on how to deal with the difficult creditors. If all others accept near 50% payments in full and final settlement, how should I approach the ones who are firm. I need rid of the stress these debts give me as I have not been well, mainly because of the difficult situation I got myself and my family in to. As a result of my medical difficulties, I may well lose my job but I am qualified and 'clever' enough to secure other employment.

I really need rid of these bad debts for my sanity, and your help in what to say further to these creditors would be most appreciated.

  • Hi, We have been on a DMP with payplan for 18 months now and are getting constant letters from Lloyds TSB regarding debts owed to them, today my Husband has received a letter from Apex Credit Management regarding his Lloyds Tsb account basically saying "we utilise external data sources to profile our accounts carefully and believe that you have the ability to make payments on this debt".
I dont know where they get their information from but we honestly can only afford what we are paying to Payplan. Any advice would be greatly appreciated. Thanks

Hiya I have started to set up with my cccs plan and I recieved my direct debit form and all the other payment details and things I need to know. cccs has asked me if I can send all my creditors bill statments and a pay slip. I have reqested up to date statments to be posted to me and I wont have a pay slip till 25th Jan. I am just wondering if I send the signed agrement and my direct debit form out in the post will my first payment be on 1st feb ? as you wont recieve my pay slip and statments later on this month.

Im just wondering as im on a debt plan with Churchwood and im in the process of canceling it

Hi k_moor25 and thank you for your post.

It depends when you send your information in to us. If we don’t receive your documents until after the 25th, it’s likely that this will be too late for a February start date. I’d recommend that you give us a call so that we can update your file and you could make token payments for the month of February, and start your DMP in March.

Have you already cancelled with Churchwood? I’d recommend that you do this as soon as possible so that you’re not paying out money that you can’t afford or end up paying your creditors twice in one month.

    Kind regards,
    Pavan

Have you advised the council that you are the sole adult occupier ?. You will be entitled to a 25% discount on your Council Tax as the sole occupier.
I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    Hiya

I have just written to churchwood to cancel my debt managment plan with them and I am in the process of setting another plan up with cccs because its a free service, I was paying churchwood nearly £35 a month for fees and I think this is wrong.

I am just wondering if my creditors will be ok with this ? Am I doing the right thing ?
