Help on Building Insurance please

Hello,

I'm clutching at straws on where to get help on this so hopefully someone here will have the answer, or be able to point me in the right direction - I'll try and be brief!

I am in a block of flats with shared buildings insurance. In the past year I have had to make three claims for water damage from the flat above. The insurance company has accepted all of these and paid out, but on each occasion I have had to cover the excess myself, as they have been separate claims.

The property managing company have suggested I ask the flat above to contribute towards the excess, but they have declined and are apparently under to obligation to pay me anything.

This now leaves me £300 out of pocket for repair & redecorations works that were through no fault of my own. Do I really have no choice but to take the hit, or do I have any options to attempt to reclaim even part of this money?

    You would have to be able to prove negligence on the part of the flat above, to pursue legal action. This might not prove to be worth it for £300.

    In your situation, you could write to them and advise them you are holding them liable for the excesses you have had to pay out. Suggest to them that they should pass on the letter to their Contents Insurers, with a view to claiming against their property occupiers liability cover. Then see what happens.
    The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.
