Item not received - getting cash back

Hi

Recently won an item on ebay and paid promptly on 28th March - come 6th Apr seller asking if i had received item - i said no.

Opened dispute on ebay as I hadnt received item after nearly a week - it was to be posted by 31st march 1st Class.

Seller is going on about proof of postage and telling me to contact royal mail with tracking number etc - surely this is their place, keeps telling me not to contact htem and its up to me.

Have contacted ebay and they say since I am communicating with seller I cannot be helped?

Do i wait 10 days with no communication and esclate?

Close ebay claim and use paypal for refund? Paypal closed my claim as I have ebay claim!

Im really fed up now and dont seem to have any options to ensure I get a refund as seller needs to get her refund from royal mail but wont do this - dont think I can?

Do not under any circunstances close the claim - you will not be able to open another one paypal or ebay. Just escalate the claim you have and get ebay to make the decision unless the seller can prove delivery you will be refunded

Royal Mail don't class post as lost until a few weeks after it was posted unless it was sent special delivery (next day) so PayPal or eBay shouldn't give you a refund if the case is disputed yet.

However, unless the seller has proof of delivery they have to refund you and take up the case with Royal Mail themselves.

thats hte thing - ebay wont let me escalate and paypal closed the claim for me?

I sent an item to a buyer in Germany just before Christmas. They never received it and they opened a dispute. Paypal basically said no proof of delivery, refund issued more or less. Ebay has taken this mantle over now but it should be the same.
The seller claims from royalmail the buyer gets a refund end of. I ended up giving the refund and royalmail did give me my loss back, no loss but no profit.
