Benson Beds can I cancel order?

We ordered and paid for a bed from Bensons on 22 March, a delivery date was set for the following week.
On the morning of delivery we had a call saying the bed "hadnt been put on the delivery van" We werent given a further date because we were off on holiday the following day. Ive just taken a call and was told the bed will now be delivered in May sometime. When I queried this I was told we could go to the store and choose another bed.
We are really cheesed off and would like to cancel the order and get our money back but the small print reads
"Your order constitutes a legally binding contract with us. Cancellations will not be allowed, except in accordance with your statutary rights.
Can we cancel and get a refund?

People have been on here before regarding cancelling with Bensons for pretty much the same reasons as yourself, seems it's nigh on impossible, I think as long as they deliver in a "reasonable" time frame there isn't really anything you can do. (Don't have any idea how long is meant by "reasonable" I'm afraid)0

Shortly after posting we had a call from a Benson Beds van driver who said our bed would be delivered withinn the hour. I said we had just been told it wouldnt be available until May, the chap was adamant that he had it. He then rang 20 minutes later and said "sorry we dont have your bed after all"

I got messed around with Bensons a few years back, only sent the mattress and no frame. Kept telling us different excuses as to why it hadn't arrived, it has been over a month sleeping on a mattress on the floor. In the end I sent them a letter saying they had 7 days or I'd be demanding a refund. On day 6....ta-da!! Bed frame arrived. Funny that.Do good deeds and you could raise the curtain, do good deeds and you could really raise your life....0

First of all try to cancel. When they refuse tell them that you are going to take the matter to trading standards. Then get a reference number off trading standards and put it all in writing, clearly stating that you are sending a copy to trading standards, and quote the reference number.
I would tell them that you will no longer accept delivery if it does turn up, as you have been messed about so much previously.0 -
it was only ordered on the 22nd of March, we have had 2 bank hollidays since then which may have slowed things a bit, that doesn't seem like an outragous legnth of time to me, bit premature to involve trading standards...0

It isn't when they now say that they will be delivering in May, and they have been messed about twice.
The reason you need to involve Trading Standards right from the start with Bensons is because they are well know for not allowing people to cancel.0 -

I dont understand why we were shown a list of delivery dates to choose from if the bed doesnt seem to exist. We went to a lot of trouble on the supposed date of delivery, removing our bed, clearing the hall and ringing (and paying £20) to council to pick up "old" bed.
We have a son with severe learning difficulties and it is incredibly difficult to go shopping as a couple and can only visit local retailers very quickly!! We still havent been given a definate delivery date just a vague reference to sometime in May.
I will contact trading standards, thanks again.0 -
I had a similar problem with them last year. We were moving house and I bought bunk beds for my children for the new house. They were in stock on the back of the store I'd bought them in, apparently, and they could deliver next day. "no, so" says I, we are moving in two weeks, can you deliver them the day before. No bother, says meladdie-o. Come delivery day (we had actually moved in early but left the beds as hadn't been sure about mucking about with delivery dates, the boys had slept on blow up beds for the 2 nights as beds from old house had been disposed of) and Mr Bensons Beds phones.
"Sorry your mattresses are out of stock"
"Don't be daft they were in the shop when I bought them."
"Well, 'cos you never took them away we sold them and yours haven't arrived yet!"
"Well my kids don't have anywhere to sleep."
"You shouldn't have thrown your old beds out then. should you!"
"When can I get them?"
"Six to eight weeks"
"!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!"
"Can I have my money back then I'll go elsewhere, my kids need beds"
"Sorry if you read your paperwork you'll see we don't do refunds." Hangs up"
So after going to the shop and ranting very loudly when it was pretty full, I got my mattresses as if by some miracle six days later, and they waived the delivery charge. Cheeky s0ds. I only got the beds as a short to mid term temp measure, as we were skint but desperate and didn't want to use CCards, and the quality was OK, but after a year they are beginning to fall aprat, and new beds will be purchased this side of the summer hols.
Do not buy from Bensons Beds. Crap Quality even Crappier service.
