Hi everyone - I'm looking for a bit of advice on the PPI front.
My husband had various credit cards and a NR loan, and ran into a bit of bother paying everything back. He kept all the debt secret from me and I only found out by a cunning bit of detective work.........
However, we worked together to try and solve the problem and through the DAS system available in Scotland he is repaying all the debt back.
Which brings me to my question or should I say questions.
My husband knows on the loan he has with NR he has PPI - he was told if he didn't take the PPI - no loan, so he took it - that was in April 2007.
Also he had 5 credit cards but isn't sure if they also have PPI added to them.
How do we go about finding out if any cards have PPI attached and is it possible for him to reclaim on the NR loan?
One more thing - I have read through other posts on here and have noticed in one or two posts that once PPI is successfully paid back back, the loan company try to renegotiate the terms of the loan - ie increase the interest rate. As DH is repaying his debts via DAS his interest is frozen - how, if at all will this affect his chances of reclaiming?

Don't try to keep up with the Joneses - Drag them down to your level - it's cheaper .

Hello there.
The PPI is worthless now anyway, so I would certainly try to reclaim on these, and of course it seems when it was sold to him they forced the PPI on to him, so he has a case, defo give it a go.
This PPI probably have not helped the debt and have worsened it too.
If your not sure what PPI was added to, you could write a letter to request for the information as a Subject Access Request (SAR) to the data dept or head office of the bank.
They have 40 days to comply, and you enclose £10 postal order or cheque payment for this request.

A cheaper way though is to just request for the copy of the Agreement, enclose a £1 cheque or postal order, and request they send the copy by 12 days of your letter. Just a simple letter here will do.
Remember though to enclose account numbers to either the SAR or the agreement request and personally I think its best to post by recorded delivery - for your proof of posting.

Your correct in stating if successful they have the right to refund the PPI towards the debt to reduce the balance, and I also believe that any interest if they uphold in your favour would be paid directly to you.
However, many will try to argue that they believe the refund should be awarded directly to them because due to being mis sold in the first place, have been out of pocket and you may not have been in such a position now if it wasn't for this sort of thing.
It can vary though in how they refund, it may differ from one bank to another, but to what I know of it should not intervene with the payment plan that is currently ongoing, unless someone else knows different on this one.
No harm in trying though, they have 8 weeks to respond to the reclaiming and if they don't uphold in your favour or at least give a reasonable offer, you are in your right to take it to the Financial ombudsman service (FOS), they should enclose details of the FOS in the final response.

The PPI has almost certainly worsened his/our situation - it was a massive loan £25,000 unsecured :eek::eek: so I'm assuming that PPI payments are massive and adding greatly to the outstanding debt.
I know this may sound like a right thick question but who/where do we send the reclaim letters to? The loan is with NR - but I don't know where to start, as I have, personally never dealt with them.

I could have cheerfully throttled him when I found out, it's a lesson learned I suppose.
