seller hasn't done a HIP

hi all wonder if you've got any advise for this scenario,

we are purchasing a house from a private seller

we saw his house was for sale as he had a homemade for sale sign in the garden with his mobile number on, so thats how we arranged the viewing etc.

we are now progressing and we have asked for the HIP and he says he isn't going to do one as its a private sale.

out solicitor says he needs to provide as he marketed the property, and that it would cost us 260 to do the searches that she needs.

what do we do? argue with the seller or try to get the solicitors to sort it out?

any thoughts anyone on an amicable way to resolve:(

    Nothing to do with your solicitor. The seller need a pack legally because they are marketing. Tell them this.
  • The seller is required to provide the HIP. A private sale does exempt this but the fact is the house was advertised albeit with a private board to avoid agent fees. £260 for a HIP is a bit high. I would love to know where one can be done for £100 as the EPC will eat most of this cost, but anything between £170-220 is about the norm.
    Above all they SHOULD:D have had the HIP done before advertising it and although rare a fine is possible if found out.
    Its their costs. If they want it to proceed i would insist they paid it, and I am sure their solicitor will point out this liability, they may be chancing their arm you will pay for it.

    i've also had the electric report......3k work of work, battle number 2 coming up i think :( ..............i'm wondering if this is all going to be worth it.
