Car Finance Company and my rights

I wonder if anyone can help??

I bought a new car on finance after 3 months the car had a fault ( leak in the passenger side door) I have given the company 4 opportunities to repair the car. 3 of which were at the original dealership which subsequently closed down and once at another branch but still the problem remains.

I was eventually advised to reject the car under the consumer credit act, by a customer service representative for the car company after reporting my problems, despite numerous attempts I was told I was unable reject the car as the fault did not make the car unfit for purpose.

I wrote the finance company of course they fobbed me off sending me back to the manufacturers. I decided to take things into my own hands and refused to pay,

I am now being taken to court for the return of the car and the balance outstanding on the credit agreement.

What are my rights as I have given ample opportunities for them to repair the problem I did request a new model or a refund and was refused both.


Please help :(

  • Is the metalwork of the door flush with its surroundings, or is this just a leaky door seal?

    If the latter, I'm afraid I have little sympathy. Such things are very easily rectified.

    You need to start making your payments again and quickly.

    People that try to "take matters into their own hands" with credit agreements and disputes deserve what they ultimately get - a knackered credit rating and no car.

    You should never stop paying in cases like this. It is not the finance company's fault that the car has a leak - your complaint is with the seller. The finance company are entitled to their payments as you agreed.
    I used to think that good grammar is important, but now I know that good wine is importanter.
