The decision as to whether a claimant passes the PCA is down to a DM. DM's do not have targets as to how many people are allowed to pass or fail the PCA.
Infact it costs more to the 'public purse' to have to go through appeal processes, there is a clamp down on getting the people entitled to what they are entitled to first claim.0 -

I think your comments are quite rude and uneccessary when the OP has come on here asking for help. If he has been on IB for 21 years then I would suggest there is a medical reason for this - perhaps you should think about how it comes across on a public forum rather than just posting in haste. I would remind you of one of the forum rules PLEASE BE NICE TO ALL MONEYSAVERS
OP - you need to contact your local CAB or legal services commision office and see if you can get an appointment with a welfare benefits specialist who will help you go through the appeal process. It needs to be done quickly though as you only have a certain amount of time in which to do it. There have been quite a few suspect decisions recently, and the fact that your doctor has seen fit to sign your husband off for 21 years says that he is not fit to work - have you tried to claim for DLA if he has issues with his back?
The OPs husbands GP will not have signed him off for 21 years, once he had passed the PCA he would not have needed anymore med certs.0 -
Thanks to all of you who replied to my post, I certainly wasn't expecting that sort of response! Some good, some not so good... all I can say is that if he was fit to work, he would be doing but we'll be contacting them on Monday to have the decision looked at again. It just makes a mockery of the doctors and consultants etc though who've said he'll get progressively worse ( and that was 15 years ago and yes he has)

What is your husbands condition/s and/or spinal problems?
And what treatments/surgery/physio etc. has he had?

Its a long list... bottom 3 vertebrae fused together, one side of vert thicker than the other so all the disc space is narrower and lots of trapped nerves, a nick in his spinal cord about halfway up, sciatica, arthritis in both hips and knee, plantar fascitis, tinnitus, vertigo and he gets really really depressed! He's had lots of different physio treatments, 3/4 different consultants who said years ago they couldnt operate because it may make other things worse. Obviously some of it has only started in the last few years, but apart from the ear stuff, all links to the back problem.
Yes he does get DLA, higher mobility was awarded years ago.0 -
This sounds extremely painful. I had back problems for several years after being assaulted by a pupil. At first it was so bad I needed 8 months off work and then worked the next two years in constant pain. Fortunately its less all pervasive now. Back problems can be just miserable because it effects even the slightest movement from turning your head to look at someone in conversation to pouring a cup of tea. I wish your hubby well with his appeal.0
