Scottish Trust Deed help!

I hope someone can help -
My OH is currently in a protected Trust Deed which has been running since Nov 2007. Out of the blue last week we got a letter from Buchanan Wells Clark stating that they were pursuing him for unpaid Council Tax for a flat he owned for six years and vacated in 2001. (This was before I met him) He is admant that he paid this at the time but has no receipts. The trustee has told us not to worry about the letter and to forward it to him to deal with.
My question is: as we didnt think this was a creditor we obvliously didnt state that at the time the trust deed was being set up. Can/will they make us pay this bill? Its over £3k!!!
I would really appreciate some advice! Thanks in advance.

My understanding is that debts this old would be statute barred provided there had been no acknowledgement of the debt in the inervening period however CT may be treated differently.
If it was paid then could it be possible to request copies of bank statements from that period which might provide evidence of payment (bank will probably charge for this).:shocked: Debt @ January '10 =£79712 :shocked:
