Fixtures & Fittings List

Hi all,

Quick question:

Something was on the F&F list as not being included, but for sale at £100.
We declined to buy.

It was still in the property when we moved in (December 09)
It is still there now. We have been asked twice by the vendor if we want it for the £100. We have declined.

It's still there. How do we stand if they turn up and want it back? Presumably they have to give us reasonable notice to arrange collection?

Just curious as it's been so long if it's now 'ours' by default as it wasn't removed at change of ownership of property or if it's still legal theirs. We are not bothered either way so they are welcome to collect - just wondered how we stand.

    Erm you moved in and they left it?

    I reckon it's yours now.

    Write to them say if it's not removed by X date (Give them a week absolute tops) then you will get rid of it yourself and charge them for it.

    OR just ignore them.

    You could check with the solicitor but anything they've deliberately left I personally class as yours now. Whether the law says so or not is a bit different.
    But is it immovable? Why didn't they take it?

    I would say at the very least any collection would have to be totally at your convenience and their expense.

    What is it out of curiosity and do you mind having it there? If it hadn't been £100 would you have been happy to keep it there?

    Refer to your two previous declinings of the opportunity to purchase and say " this item will be available for you to collect on x date between y and z times" The costs involved in them moving it will probably lead to them saying that they'll' leave it with you.

    You could have notified them that they had "inadvertently" left it behind as soon as you had moved in.

    We are happy to leave it where it is.

    I would have bought it - but someone at work has one we could have for nothing - so I'm not going to pay £100 for something I can have for nothing (sorry that sounds penny pinching but I'm on the Moneysaving forum for a reason!!)

    I don't want to say on here what is is - you never know who's on the forum!
