Whitney Houston Seatwave Refused Refund and Overcharging?????

Hi, I have bought 2 Whitney Houston Tickets before Xmas for a present for tonights concert at the MEN Arena Manchester. It was cancelled the other day due to illness. Now the problem I have is thet I have rang Seatwave and expressed that the person I have bought them for is out of the country in June when the concert is pencilled in for due to being in the Navy.

They have refused my wish for a refund and advised me to put them on Ebay. Are they within their rights to do this.

Also; When I booked the tickets the breakdown was as follows

£124 per ticket x 2 = £248
Seatwave Commission inc V.A.T £42.78
Delivery Charge £8
Total £298.78

When i received the tickets they had a face value of £75 plus £8.25 Service Charge I presume with each Ticket a total price of £83.25.

I am wondering where I stand on both instances.

    well you paid the price they sold it at,they can charge as much as they like
    however you should be due a refund given the cant supply the 'goods' as you bought them

    Seatwave is a ticket resale site, so effectively it's a private sale between you and the person who listed them (aka a tout). According to Seatwave's terms and conditions, "All sales are final and Seatwave is not responsible for the actions or failures of any venue, performer or promoter". Any action would have to be taken against the person selling the tickets, have you tried contacting them directly?

    There are currently no laws against reselling tickets (with the exception of football tickets), and sellers are entitled to charge whatever they like.
  • You didn't purchase the tickets through Seatwave. They, ultimately, are a mediator between you and the seller. Seatwave fulfilled their contract to you by facilitating the exchange of the tickets / cash between the two parties.

    The cancellation is the responsibility of the concert promoter who will, through their agents (ie, TicketMaster, See Tickets, etc), refund ticket purchasers. Unfortunately for you, you have no contract with the promoter or the official agents (the contract is between them and the original buyer).

    I am sorry but that is rubbish .... if a concert is cancelled / date changed & the tickets were bought via a legit supplier - eg. ticketmaster, then you are enttiled to a refund - you may have to pay a admin fee ... otherwise companies could arrange tours, cancel, keep the money & become rich.

    The OP bought tickets from a private individual, so the only recourse is to sell on ...

    Thankyou for the help. don't fancy my chances of selling them on Ebay after her recent concert though.

    Why don't you try contacting the seller directly for a refund?

    In theory, they sold something (a ticket for a concert on a set date) that didn't exist, so if they say no, it might be worth threatening them with the small claims.

    Presuming new tickets will be issued for the new dates, will these not then be sent to the vendor?

    Cannot believe anyone would pay almost £150 just to see Whitney Houston!

  • Hi golfkec, I too have booked tickets through Seatwave for concert on 8th April which was cancelled. My husband works abroad and took holiday entitlement to be home for two weeks so we could go to the concert. He had to go back to work and although the concert was rescheduled for 16th June 2010 he will not be able to attend. I booked the tickets through Barclaycard and have been in touch with them. They told me to speak to Seatwave regarding refund. They stated I would not get a refund as the concert had been rescheduled. Got back in touch with Barclaycard they told me to put everything in writing and they would help to sort it out. Apparently when you use the card to buy in certain circumstances you would be insured via them. Maybe if you booked through credit card they might help. Also when on the internet I discovered Whitney Houston's UK promoter Marshall Arts. Second to last paragraph states - Concert promoters Marshall Arts have asked ticketholders for the Manchester and Glasgow performances to retain their tickets which will remain valid.

    Organisers said those unable to make the re-scheduled shows should apply to their point of ticket purchase for a refund.

    I have enclosed this information for credit company surely with this information to hand and the fact that we did not book tickets for 16th June as like you would have been unable to attend. My total for 2 tickets was £507.00 which I feel is far too much to lose and very greedy of Seatwave.

    I will be back in touch and hope to have some luck with a refund.:)

    Don't bother going to see her. I was one of the poor fools at the 02. There was practically a riot because she was so !!!!. I reviewed it on dooyoo http://dooyoo.co.uk/discussion/whitney-houston/1436586/

    (I don't earn anything from non-members reading, that's not why I posted the link. I just can't believe they are still conning people with these concerts. Consider yourself lucky it was cancelled, otherwise you'd have wasted your money plus travel plus refreshments plus a few hours of your life).
