It was certainly not my intention to scare (and I apologise if I have done so) anyone with my post I was merely trying to point them in the right direction to look for the definitions of what is/isn't a HMO licencable or otherwise. Perhaps I should have said "whether or not it is classed as a licencable HMO" rather than "whether or not it is classed as a HMO" however I don't think I said or implied in my post that the that the property was or should be subject to licensing either mandatory, selective or additional, however it is my understanding that some local authorities do licence smaller HMOs. As the property discussed is a flat it is reasonable to assume there may be other flats in the building hence my point about a converted house.

This HMO business looked very straightforward when the Act was first published last year - - more than 2 individuals who are not related = HMO - and three storeys = compulsory licensed HMO.
However, what has made it more complex is that there are discretionary powers which have been granted to local authority housing departments , dependent on their own local housing needs. in my view the Only Way to ascertain whether a particular house/flat/property is a HMO is to ring your local authority HMO unit and ask them.
Of the 6 local authorities i have contacted since April with queries, they have all interpreted the ACt in a different way.0 -
So in short, to answer the OP's original post, yes, you can open a bank account with 3 names!
