using claim management companies

I had PPI claim with Swift and new how difficult they were so went with a claims management company (I know!) This was back in June last year. For months this Company did nothing after numerous phone call a get a letter from a Solicitor who had been passed my documents from the Claims Company. He started from Scratch with letters to Swift and Broker (capital). It was a no win no fee. Broker has said it was missold and is paying up £5700 ppi plus interest and is paying 2500 my solicitors costs (for a few letters). Now the claims company want there 20% cut also out of my amount. I dont agree, i think that the solicitor did all the work and got paid from the company do I have a leg to stand on in withholding or do i just pay up. Any advice? And I agree i should have done it myself!!!!

The agreement that claims companies usually get you to sign is that they get paid regardless of your or other input. They usually take you to court and the contracts they have are usually pretty good in saying that they did the work and are entitled to be paid.
Yes, we know in reality they did diddly squat but that doesnt really matter.
The solicitor who took on your claim afterwards, if it was really a solicitor, should have warned you if they were aware that another firm as already acting on your behalf.I am an Independent Financial Adviser (IFA). We once used a "no win no fee" for an "employment claim" and won out of court BUT as we telephoned a company first and they just passed the case over for us (nothing else other than that) we ended up paying 25% to the company we rang and then 25% + vat to the solicitor also. This mean't we got back less than half. It was actually in the small print and a right rip off. TBH though we were just glad that we won (my son actually) and the money was not the issue but if this had been money that we had actually "paid out" (like yourself) we would have been annoyed.Hi
