Bit of advice needed before paypal dispute. :)

Hi all, :j

I bought some brand new led indicators for my husbands motorcycle a few weeks ago, and unfortunately one of them is faulty (none of the 12 leds are working). They were also slightly misdescribed in the listing. Simply put 'fully chromed lights', when they are in fact plastic fake chrome 'effect'.

I've sent the seller numerous emails asked if I can send them back and get a refund but he hasnt reponded in 3 weeks, he's obviously just keeping quiet and hoping ill go away. (he is still selling items each day mind you).

So im going to start my first ever paypal claim. I realise i probably need to proove that ive sent them back to get a refund.

So what I want to know is how do I go about making sure I dont void my claim. Do I send them via recorded delivery or special delivery? does it matter which one? Also do I just need the tracking info for the returned item (i.e. the red recorded delivery slip) or do I also need to request a proof of posting certificate as well?

I dont want to lose my claim as its nearly a £50 item so some advice from someone in the know on how to go about things would be mostly appreciated. ;)

Many thanks in advance guys.

Sal :T

You have two issues to address, firstly proof of receipt by the seller and also insurance for your own purposes in case the RM lose the items. Therefore you will need to use special delivery, but you won't need a COP as delivery is what matters and not posting.

Recorded will be sufficient for paypal's purposes but won't be enough if your parcel is lost as it only covers up to £32.

However, don't send the items back until paypal tell you to do so.

    double concurr with soo here,

if the ebayer is still active, pull the contact details and phone them, if there is no phone number, report them for innacurate contact details.

PLEASE ensure you return the item by a trackable method. if you dont then they can claim that you never sent it back. likewise, if they didn't use recorded or special to post it to you, you could claim that you'd never received the item!

ok, thanks for the tip. Is it ok to still send the item via recorded delivery, i know its only ok up to £32, but id like to save on the shipping if possible. So if paypal accept recorded delivery as a postage method, i would like to use that.

Can I just double check, I dont send the item back until paypal tell me too?

many thanks for all your help.

    sal :)
  • Recorded delivery is accepted by PayPal as an online trackable method for items £32 and under. However, your item is worth £50 and therefore to cover yourself you will need to send the item via special delivery. Please don't be tempted to try and save on postage by sending recorded delivery as this could cost you in the long run.

Yes, wait until PayPal tell you to return the item to the seller.

Start your chargeback first and wait to see what paypal tell you to do. Does the seller have lots of feedback ? and yourself ? paypal do take this into account especailly if the seler has a history of chargebacks.
It can be quite hard to prove items not as described and paypal may well ask you to proved proof of this and photos do not count. You should mention in your claim that the items were described as chrome when they were in fast plastic.
Any problems post on here and some will advise but I would not get to worried about the posting issue this now as chargebacks can take a while ( about 2 weeks in my case which apparentily is quite good ).
Sometimes sellers buckle when paypal get in contact with the chargeback and refund, which in case great. However others dont in which case just respond to paypal as required and hopefully things will go your way.
