HMRC Small claims refund

Can anyone please shed some light on something for me.
I made a claim for bank charges refunds through HMRC Small Claims just before it all went on hold. I seem to rememeber something that if I cannot claim, I am entitled to the initial fee back via a refund. maybe this is just wishful thinking but I keep thinking about it and if i dont get it cleared up, I WILL go insane!!

  • Erm....not entirely sure. The situation was that the claim was made about a month before the stay was sanctioned and it remined in this status until the ruling was made by the OFT so thats as far as it got!
    I have not done anything about my claim since the OFT ruling was announced. Do I have a claim for a refund?

    Can you clarify the HMRC small claims bit. Have you filed a claim in court yourself or through a company?
    Until I know what the terms of the stay are then I can't advise really.

    I'm afraid it is wishful thinking on your part.

    The fee you paid the court was the filing fee ... a fee made for initially filing your claim.

    As you filed the claim, then the fee you paid was due and is not refundable.
