  • I'm not disputing this fact hence the reason I have not started ranting and raving about bank charges and so on.

    The point I am questioning here is the point of Law.
    The personal Loan is a separate area of business arranged completely separate from the current account. The credit Card is with a completely separate Financial Institution and as such the only person able to authorise funds from this account to be dispersed is myself or the credit card company. As such I can dictate what these funds are to be used for.

    A separate agreement had already been reached regarding paying the overdraft and associated fees and I am not disputing the overdraft fees.

    The point I have tried to put across here is that as the Customer Services Operative Informed me that the payment was going to be processed and made towards the months loan repayment. He was legally obliged to do just that. By diverting the funds to another account I believe he has committed an offence of Fraud by False Representation contrary to Section 2 of the Fraud Act 2006 by directly informing me that this payment was going to go straight into the personal loan account.[/QUOTE]

    I've highlighted the word dishonest in this section as making an error which was corrected in less than 7 days is not something I would class as dishonest.     there are a few on here that think they are all high and mighty, look down their nose at people, and imply we're all theives and can not manage money or understand the rules.

    they have no understanding of the real world, many people like myself only had problems with for my example HSBC because the company i worked for went bust, i was on 30k+, had OD and credit cards which i could manage on such a handsome salary.

    I was an interior design consultant, then i had to sign on for 3 weeks, got myself a sales assistant job (homebase selling paint if you want to know) on minimum wage just so i wouldn't have to claim benefit because i'm a fit and able bodied man, and refuse to claim when there are still a few jobs out there to be filled.

    obviously i couldn't manage my minimum payments on my HSBC credit card, and had trouble with my OD due to reduced income, HSBC just defaulted me, threatened me with legal action, didn't even try to help me, and my savings account with them raided to repay some off my debt.

    i repaid my debt initially with token payments, then larger payments, i am free from my debt i owe to them.

    yet people are so quick on here to imply i'm bone idle, or on this thread alone, can't manage money or understand rules, or worse still suggest someone like yourself is stealing.

    Could you please learn to use a computer and quote properly please.

    If you were on £30k you shouldn't need an overdraft or large credit card.
