consumer rights and car financing companies

I wonder if anyone can help??

I bought a new car on finance after 3 months the car had a fault ( leak in the passenger side door) I have given the company 4 opportunities to repair the car to no avail.

I was eventually advised to reject the car under the consumer credit act, but was told I was unable to do so as the fault did not make the car unfit for purpose.

I wrote the finance company of course they fobbed me off sending me back to the manufacturers. I decided to take things into my own hands and refused to pay,

I am now being taken to court for the return of the car and the balance outstanding on the credit agreement.

What are my rights as I have given ample opportunities for them to repair the problem I did request a new model or a refund and was refused both.


Please help :(

    the car and the finance are separate though,no?
    regardless of what you do with the car you are still liable to pay the finance company what they are due

    /I agree, you made a massive error in refusing to pay, you need to pursue the dealership under the sale of goods act.
    Back by no demand whatsoever.

This bit of your post is unclear. Do you mean you asked them to repair it 4 times and they said no? OR have they tried to repair it 4 times and the repairs have failed?

  • I allowed the dealership to repair the fault 4 separate times. The actual dealership that I bought the car from has subsequently closed down but another branch did the last repair which still did not rectify the fault.

    I was advised by a customer service representative from the company to reject the car and despite doing so repeatedly I was told by the dealership that my rejection would not be upheld. Hence the reason for my interaction with the finance company.
