redundancy pay entitlement ??

hi there

my friend is been made redundant, she works as a manger of a sandwich shop, the owner has decided to sell up.

She has been there 11 yrs will she be entitled to redundancy pay , if so how is this worked out ?

    Yes.

    Depending on her age she will be entitled to at least 11 weeks pay capped at £380 per week + she has the right to claim 11 weeks notice (to be either worked or paid in leiu)

    Check out the direct gov site for info on this including a redundancy pay calculator - if she is over 41 the payment will be higher.

    Edit - Technically speaking and before redundancy is a consideration, she also has the right to transfer her employment with the sale of the business to become an employee of the new owners under TUPE law. Again, details of this can be found on the Direct Gov website

    Presumably if the company is sold and carrys on operating then she dosn't get a chance to take redundancy?

    Not unless the job was going. She would just continue as normal under her exisiting arrangement.

    Yep agreed - Similarly, if they offered her TUPE on the same conditions and she said no she would be resigning and not redundant
