Supplier cancelled half my order (no stock). Allowable?

Hello.

I ordered an item that was bundled with another item (that was for sale separately for around £80 - it was bundled for an extra £1). The expensive item arrived and several days later the second item was cancelled by the suppliers due to lack of stock. My problem is that my choice was influenced by the second item and although they sent a cut'n'paste apology and refunded £1, I feel cheated. Are companies allowed to do this? What options do I have? The price I paid for the first item was about right, and I don't think they did it on purpose.

    Anyhow, you could always reject the item you received under the Distance Selling Regulations, presuming more than seven working days have not elapsed since you received the item.

    They cancelled the 2nd item 8 days after I received the 1st item. I feel cheated because the 2nd item was something that I wanted... But the price for the 1st item was reasonable so I *might* have bought that anyway. The fact that were so blas! about cancelling it without any explanation and the boiler plate responses to my questions made me a little angry.

    I was looking for clarification as to whether they can cancel an ordered item that's part of a bundled sale (e.g. "here's your new car with a free tank of petrol, by the way - you can't have a free tank of petrol")

    I think there is two problems fo you:

    a) The 2nd item wasn't a free gift, so the above analogy is not comparable. Since you paid for the 2nd part, they have fulfilled their obligations by refunding you.

    b) What is it that you expect them to do? If they don't have the item, you cannot make them send it out.

    I think you're right. I'm blowing off steam. I guess I think that they should have known what stock was available before selling it.

    I just got miffed about it.

    Actually, I can't help feeling that this might be deliberate i.e. 8 days is too long to return the first item, then coincidentally the second item gets cancelled... The very item that would have swayed the deal for many people.

    How much was the second item on its own? I would be cheeky and ask for the refund at the full cost of the second item, or tell them you'll continue to wait until it's in stock.

    Frustrated contract. I would be inclined to return the first item under DSR, despite it being 8 days - because the contract as a whole has not been fulfilled - and to my way of looking at it, the DSR clock only starts from the day of delivery. Evidence of a bundled deal - flyer, advert would be useful.

    The eight days being mentioned is eight working days starting with the day after delivery.

    So if the item was delivered on or after monday 29 March you can still reject it under DSR if you are quick.

    OK. thanks everyone.
    They were selling the just the 2nd item for around £80 - but bundled it for £1. I think I'll try asking them to keep the order open in case they get the item. I don't particularly want to send stuff back as it's what I wanted for a reasonable price.
