Can I still claim Bank Charges

I tried to reclaim Bank Charges before the court case, then things were put on hold for some time. After the court case I received a letter from the bank stating they had won the case and were not paying out. I thought this was the end of the line for my claim so decided to file all correspondence.
Recently I heard that there's still a chance I can claim so decided to log on to your site for help. I get regular email's from you and knew that all information would be up to date.
I decided to go down the Ombudsman route, but then found after reading your template letter, I would have been given eight weeks by the bank to respond to their letter regarding the claim.
I would like to know if I have lost my chance by not replying within this time or can I still proceed down this route. Maybe I have to start again as if I had not previously tried to make a claim.
Please can someone advise me on this situation.
