Hi there,
I am a PI lawyer (i have the horns and everything) and if this case was brought to me, i would take it no win no fee and see what can be done. There are numerous variables that could affect the outcome, for all you know the padding on the area could have been ripped off by another child only moments before the index accident, then again we might be able to prove that sufficent checks were not carried out and that this was "an accident waiting to happen".
Personally I would seek legal advice before writing a letter. Firstly it saves you the hassle, if you get a no win no fee solicitor who makes no deductions from your damages (make sure you check this point before signing anything) then what have you got to lose by allowing them to do the work for you??
Admittedly i'm biased, but get a solicitor and let them do the letter writing, it's what we're trained for

What Personal Injury company would you guys suggest? I was recently in a car accident and wanted to claim but am not sure which company to use. I've heard of Claims Direct and also have heard good things about Mckeowns Solicitors, who do you guys suggest?0 -
There are so many companies out there to chose from. I would always go with word of mouth. I find that alot of my repeat client's have been recomended by friends.
Make sure you double check that you will recieve 100% of your compensation before you sign anything!

There's one pretty significant point that has been missed so far, and that's the value of the injury itself. It's been a good three days since the accident, so how is it healing? You mentioned that no stitches were needed, which is a good thing for your daughter, but also suggests a minor injury in the grand scheme of things. It may well be the case that this injury is so minor that it is simply not worth pursuing a claim for it. Clearly if your daughter has been distressed or otherwise affected by the accident, or if the cut results in a scar, it's a different matter entirely, but for a simple cut that heals quickly and without complication it may be the case that it is not worth your time to pursue legal action.
On a side note, anna is right about not writing a letter. I wouldn't recommend it either. Obviously if you've already sent it then it cannot be undone, but if you're intent on pursuing legal action you need to leave letters regarding liability and disclosure to solicitors. If you're looking for an apology and such then you are of course free to write a letter, but you don't need to go into details about the condition of the play area.
On a final note, again as anna suggested if you do end up making a claim it should certainly be done on a 'no win no fee' basis, and considering what you've put down here so far I would certainly expect that any half decent PI solicitor would accept the case on that basis."MIND IF I USE YOUR PHONE? I'm just reviving this old thread for a bit of advice.
My son (5) went to a party yesterday at a soft play centre.
In the centre was a huge timber play house with stairs & a door about 6-7ft up off the ground, suddenly there was an almighty crash & my son fell through the door & landed on the hard floor behind the serving counter. His injuries are bruising to his back & severe grazing & siffness to his neck. No medical help was offered (apart from an antiseptic wipe!) luckily a dad there was an ambu medic & took over.
The door has a lock on it but it was obviously left unlocked or not checked in the morning (although the owner swears she locked it!) if she had he would of obviously broke the lock off when he fell through it but a mum locked it after. My son swears as do his friends all he did was lean against it, I signed an accident form but once he came round from the shock he wanted to go play so didn't seek furthur medical help. We have pictures of the door & his injuries.
I'm not one to make a fuss really but if it was one of the toddlers there it could of killed them, as it could of my son if he had landed differently or the counter gate hadn't broken his fall.
All the mums at at school are fuming about it & advising me what they would do! should my first step be a letter to the soft play area? I'm just looking for advice on how to deal with this situation.

I keep saying the main thing is he's ok & I was going to just send a complaint letter detailing the whole incident & suggest removal of the door or heavier fixtures on the door (as it was a small lock) & play it by ear with there reply but hubby thinks a lesson needs to be learn't as it could of been fatal & we should go for compensation.
A lot of the mums at school agree with hubby, I suppose I just want to see what others would do?.
Am I right to think if I just want to complain I should contact them but if i want to go for compensation I'm best not to do a thing & go for legal advice.0
