You could contact your phone supplier, to have these nubers blocked. Also, you could write to your creditors and demand that any further communication, must be in writing, as there is a possibility that the future of the debt will be decided by the courts (no need to say bankruptcy court at this stage). You can also state that you have asked them to communicate in writing only, and that any further unsolicited telephone calls will be classed as harrassment and therefore illegal (have a look at OFT website).

Ultimately it is the banks decision whether to allow an account (which is in credit or has a nil balance on the bankrutcy order date) to remain open. any wages or benefits necessary for living expenses the OR will not claim, but the OR will inform the bank of the bankruptcy order. some banks dont allow bankrupts to have any accounts.
Re: payments to your Trutree: under and Income Payments Agreement the payments continue for 3 years as standard, unless say you are retiring before this. so CAB misadvised you. You will be automatically discharged after max 1 year, but payments under the IPA will continue. Creditors cannot pursue you for repayment of a bankruptcy debt after discharge but some debts cannot be included in bankruptcy eg overpayment of some benefits, student loans, fines issued by a court or the police.

I was also told with bankruptcy you still make payments for a year before they wipe the outstanding amounts out. Thats what CAB told me.0 -
I don't post much on the site but after reading this post, I felt like I had to.
Some people think bankruptcy is an easy way out so to speak.... but it is far from it.
I was in 15G worth of debt, doesnt sound a lot but it was going up by hundreds every month because i couldnt afford to even pay the interest off after my hubby lost his job.
I contacted national debtline and also CAB. They went through my incoming and outgoing and said there wasent even any point offering every creditor £1 a week because I couldnt even manage that, on my incapacity and income support.
So On July 11th, I declared myself bankrupt. And I was in with the usher for the matter of about 2 minutes, then out and onto the phone to the official receiver. They were very polite and understanding.
Then 4 days later, I had a phone call from a different person from the official receivers office at blackpool. They went through my incoming and outgoing and my assets.
They took my mobile phone which i thought they would as it wasent paid off it full on the catalouge, then they took MY HUSBANDS car stereo and threatened to take his car unless we paid £200 in the next 7 days! I thought this was pathetic, at the end of the day, It was me going bankrupt, not my husband.
Then it started going worse to worse! The official receiver mentioned prison! Because id committed an offence by buying something out of a catalouge and later selling! I didnt know this would happen. Because I have a clean background with the police, apparently it could be a suspended sentance sort of thing or community service. But because of this offence, I am going to be bankrupt for 2 - 15 years instead of 6 months which i got told it would be as I didnt owe that much!
i COULDNT BELIEVE IT!
its not plain sailing like some people think it is, and it needs an awful lot of thinking about!

Hi .Just back from hols and picked up this thread again.If you go to an IP who takes on IVA then creditors pay the fees.I know this for a fact because I went through it with a former employee.Do not go DM route cos you do pay fees and with no freezing of intersee and no end date.0

sorry if this is the dumbest question you've ever been asked. Last year in September there was a guy who conned several people out of a lot of money who was jailed for life (Robert Hendy-Freegard, found guilty of theft and obtaining money transfer by deception). Having read your extremely heartwringing story, I can't believe you're the only one who this guy has ripped off, and in fact you know at least two other peope who were also cheated by him (the landlady and your dad). I'll bet that if his background was investigated it would turn out there were loads more. Is there no possibility of police involvement? Is there no paper record of your transferring the money to him? Please forgive my naivety on this question if the answer is an obvious 'no'.0

I sympathise with you. If bankruptcy is your only option it does serve its purpose though a word of warning - the financial hardship can continue for 3 years if you have surplus earnings beyond your domestic living needs.
You should also get advice on how the Offical Receiver will view your situation. Will he/she consider you are somewhat to blame? If they do this could prolong the restrictions of your bankruptcy. To my knowledge there is no financial consequence of this.
I petitioned for my bankruptcy in January and was subsequently discharged in July so it didn't last that long.
Good luck to you. Make sure you receive advice about all your worries before had. It certainly helped me understand. Shame it didn't save my relationship!!!0 -

Hi cathybird, no that's not a dumb question at all! I have been involved with the police - oh yes! After suffering the extreme indignity and humiliation of being arrested in my home in front of my father - I sought to set the record straight. I made a counter-complaint to the police about this man - along the lines of - why are you arresting me when the actual criminal here is right in front of your very eyes!
There is something not right here. The fact that I have been conned out of tens of thousands, yet the police have not done anything about him. Yet his ex-landlady has successfully got him into court recently and he was found guilty of gaining property by deception. Now the funny thing is - he used to be a police officer! He always told me that he had been in the force for 12 years. Turns out he actually had done his probation for one year then left (the police themselves told me this!). So he used to use this line of "I was a police officer for 12 years" in order to gain peoples trust and respect.
Shortly after I 'found him out' - he even phoned one of my friends (he must have snuck the number from my mobile weeks before) - pretending to be a police officer and wanting information on me. Again - I have reported him to the police for 'impersonating a police officer' - but again, nothing seems to be done about him.
I know for a fact that he has ripped of all the major banks and credit cards, by tens and tens of thousands. He does this by lying on application forms, then flitting from various rented properties after 6 months and leaving the debt behind. I found a lot of the statements in the garage and I felt sick when I saw how much trouble he was in - CCJs, DCA letters, Bailiffs and Court summons. Horrific. That was what made me see the light and quickly removed myself from the situation.
Unfortunately it has left me saddled with his debts. At the moment I need to concentrate all my efforts on getting through my BR and making a fresh start. When things are a bit more settled - I will continue to pursue this criminal and will hassle the police until they take action against him.
I do not know how the OR will perceive my story. I hope they will show a degree of sympathy. They should see from my bank statements that I have not been overly frivolous or spending huge amounts on needless things. Most of my expenditure has been day to day living costs and paying back the ridiculous amounts on the loan and credit cards. Yes, there are a few spends on there that they may question - I am not a saint and during an extremely upsetting and depressing time for me, I probably sought some solace in a spot of comfort-shopping - but that aside, it was not for thousands of pounds or on anything ridiculously frivilous. They can certainly check my story with the police if they so wish to.
I have not blown the money on drugs, drink or gambling or brand new Ferraris (I wish!). I have been dealt duff cards, started with redundancy then the final insult was to be conned by a serial fraudster and conman. If I get a BRO/U -- well so be it. Anything is better than what it is like for me now.
Last year I seriously thought I was going to prison. It was so bad, I contemplated getting a one way ticket out of here and yes, I also thought about finishing myself off. All I could see is that I had tried to help out somebody who I thought I loved and who loved me back - he had taken advantage of my generosity and bled me dry, treating me as his cash cow. As a reward for my good nature, I was arrested under 4 different charges and I was locked in a police cell like a common criminal. How quick the police were to arrest me, after that man fed them a pack of lies about me! Yet how slow they are to act when I have made serious allegations about him and have evidence to support them. I spent months having recurrent nightmares and they were always the same - me in the dock, with the judge saying 'send her down'. Now I can sort of laugh about it now - but at the time, the fear was real.
So in essence, what's the worst that can happen to me? I will go bankrupt and may or may not suffer a BRO/U - in which case if I do, I'm sure it will not be a lengthy one.
Sorry - I've just realised this has turned into an epic....never meant it to be, it's just when I get started about the whole fiasco it brings it all back and I just feel that justice has not been done and that infuriates me!

well, you know what, it's just such a shame that he's left you in such a dreadful financial state, because I'm thinking that if only you could afford to hire a private detective to look into his background I'll bet some pretty damaging things would come to light about this complete scumbag. But you obviously aren't in the right place financially or emotionally to be doing anything like that right now, with this stuff he's burdened you with to sort out. What about the landlady? Does she by any chance know anyone else who's been his victim, or would she be willing to hire someone to look into it further? He certainly shouldn't get away with it, and by the sound of it he's left paper trails and documentation all over the place, just got away with it because no one's co-ordinated anything against him so far. That's wierd that the police won't do anything about it though - makes you wonder if they're thinking he's "one of their own" and so they're going easy. For your sake I do hope not (and actually, they can be pretty disorganised, maybe that's what's happened). Anyway, the other guy I mentioned getting life shows that justice is sometimes done, and that's what I hope happens here...!!0

I would stake my life on the fact he has got a whole trail of dirt in his background!
The sickening thing is - while he roams free to continue his crimes - anybody could become his victim. Anyone of you lovely ladies on here could become his next target and I wouldn't wish that on anyone. I wonder if something happened with him in the police, something that they want to hush up a bit, hence why they are not taking action. Mmmmmmmmmm.
My priority right here and now is to get myself through the BR and get a bit more settled. Then - I will continue my pursuit of justice. My dad is gunning for his blood also as he lent him £1500 and he has never had a penny back. Dad says he's going to take the story to the Daily Mail - they love stuff like that!
